Amends the Parental Responsibility Law. Defines "acts which cause injury" and "wilful or malicious conduct".

A BILL FOR

AN ACT concerning liability.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Parental Responsibility Law is amended by changing Section 2 as follows:

Sec. 2. As used in this Act, unless the context otherwise requires, the terms specified have the meanings ascribed to them:

(1) "Legal guardian" means a person appointed guardian, or given custody, of a minor by a circuit court of the State, but does not include a person appointed guardian, or given custody, of a minor under the Juvenile Court Act or the Juvenile Court Act of 1987.

(2) "Minor" means a person who is above the age of 11 years, but not yet 19 years of age.

(3) "Acts which cause injury" means acts that directly or proximately bring about or are the reason for the damage or harm.

(4) "Wilful or malicious conduct" means conduct that has the same mens rea as required for criminal conduct. "Wilful or malicious conduct" does not include conduct where there was no intent to cause damage or harm.
