SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/12-6.5 new

    Amends the Criminal Code of 1961. Creates the offense of aggravated intimidation of a senior citizen (a person 60 years of age or older). Defines the offense. Provides that a violation is a Class 2 felony for which the offender may be sentenced to a term of imprisonment of not less than 3 years and not more than 14 years. Effective immediately.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by adding
5 Section 12-6.5 as follows:
 
6     (720 ILCS 5/12-6.5 new)
7     Sec. 12-6.5. Aggravated intimidation of a senior citizen.
8     (a) A person commits aggravated intimidation of a senior
9 citizen when, with intent to cause a person 60 years of age or
10 older to perform or to omit the performance of any act, he or
11 she communicates to the person 60 years of age or older,
12 whether in person, by telephone or by mail, a threat to perform
13 without lawful authority any of the following acts:
14         (1) inflict physical harm on a person 60 years of age
15     or older threatened or on property of a person 60 years of
16     age or older; or
17         (2) subject a person 60 years of age or older to
18     physical confinement or restraint; or
19         (3) commit any criminal offense; or
20         (4) accuse a person 60 years of age or older of an
21     offense;
22         (5) expose a person 60 years of age or older to hatred,
23     contempt or ridicule; or
24         (6) take action as a public official against a person
25     60 years of age or older or withhold official action
26     affecting a person 60 years of age or older, or cause such
27     action or withholding; or
28         (7) bring about or continue a strike, boycott, or other
29     collective action against the business of a person 60 years
30     of age or older.
31     (b) Sentence. Aggravated intimidation of a senior citizen
32 is a Class 2 felony for which an offender may be sentenced to a

1 term of imprisonment of not less than 3 years and not more than
2 14 years.
 
3     Section 99. Effective date. This Act takes effect upon
4 becoming law.
