SYNOPSIS AS INTRODUCED:

5 ILCS 100/5-149 new

Amends the Illinois Administrative Procedure Act. Provides that a State agency may not adopt a new rule unless it simultaneously removes 2 or more existing rules for every new rule adopted. Provides that the State agency may not satisfy the requirement by merging 2 or more existing rules into a single rule. Effective immediately.

AN ACT concerning government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Administrative Procedure Act is amended by adding Section 5-149 as follows:

(5 ILCS 100/5-149 new)

Sec. 5-149. Number of rules. A State agency may not adopt a new rule unless it simultaneously removes 2 or more existing rules for every new rule adopted. The State agency may not satisfy this Section by merging 2 or more existing rules into a single rule.

Section 99. Effective date. This Act takes effect upon becoming law.
