SYNOPSIS AS INTRODUCED:
 
765 ILCS 755/10

    Amends the Immigrant Tenant Protection Act. Provides that a landlord is not prohibited from requesting information or documentation necessary to determine or verify the financial qualifications of a prospective tenant, so long as the landlord requests the same information or documentation of all prospective tenants regardless of immigration or citizenship status. Provides that a landlord who is also the tenant's employer is not prohibited from lawfully collecting information required to complete any employment form requested by State or federal law. Prohibits a landlord from demanding, requesting, or collecting information regarding or relating to the immigration or citizenship status of a tenant or prospective tenant

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Immigrant Tenant Protection Act is amended
5by changing Section 10 as follows:
 
6    (765 ILCS 755/10)
7    Sec. 10. Prohibited conduct.
8    (a) This Section does not prohibit a landlord from
9complying with any legal obligation under federal, State, or
10local law, including, but not limited to, any legal obligation
11under any government program that provides for rent
12limitations or rental assistance to a qualified tenant or a
13subpoena, warrant, or other court order.
14    (b) This Section does not prohibit a landlord from
15requesting information or documentation necessary to determine
16or verify the financial qualifications of a prospective
17tenant, so long as the landlord requests the same information
18or documentation of all prospective tenants regardless of
19immigration or citizenship status, including requesting a
20social security number or relevant taxpayer identification
21number.
22    (b-5) This Section does not prohibit a landlord who is
23also the tenant's employer from lawfully collecting

1information required to complete any employment form requested
2by State or federal law.
3    (c) This Section does not prohibit a landlord from
4delivering to the tenant an oral or written notice regarding
5conduct by the tenant that violates, may violate, or has
6violated an applicable rental agreement, including the lease
7or any rule, regulation, or law.
8    (d) This Section does not enlarge or diminish a landlord's
9right to terminate a tenancy pursuant to existing State or
10local law, nor does this Act enlarge or diminish the ability of
11a unit of local government to regulate or enforce a
12prohibition against a landlord's harassment of a tenant.
13    (e) Nothing in this Section prevents a landlord from
14seeking to collect rent due under the lease agreement.
15    (f) Except as otherwise provided in this Section, a
16landlord shall not:
17        (1) unless required by law or court order, threaten to
18    disclose or actually disclose information regarding or
19    relating to the immigration or citizenship status of a
20    tenant to any person, entity, or any immigration or law
21    enforcement agency with the intent of harassing or
22    intimidating the tenant, retaliating against the tenant
23    for exercising his or her rights, or influencing the
24    tenant to surrender possession; or
25        (2) unless required by law or court order, bring an
26    action to recover possession of a dwelling unit based

1    solely or in part on the immigration or citizenship status
2    of a tenant; or
3        (3) demand, request, or collect information regarding
4    or relating to the immigration or citizenship status of a
5    tenant or prospective tenant.
6    (g) Any waiver of a right under this Act by a tenant is
7void as a matter of public policy.
