1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Fire
5and Smoke Damper Inspection Act.
 
6    Section 5. Definitions. In this Act:
7    "Fire damper" means a device installed in ducts and air
8transfer openings designed to close automatically upon
9detection of heat and resist the passage of flame and
10classified for use in either static systems that will
11automatically shut down in the event of a fire or in dynamic
12systems that continue to operate during a fire. A fire damper
13is classified for use in dynamic systems if the fire damper is
14tested and rated for closure under elevated temperature
15airflow.
16    "Smoke damper" means a device installed in ducts and air
17transfer openings designed to resist the passage of smoke and
18installed to operate automatically, controlled by a smoke
19detection system, and, where required, capable of being
20positioned from a fire command center.
 
21    Section 10. Inspections; requirements.
22    (a) Inspections and testing of HVAC fire dampers and smoke

1dampers shall be conducted by individuals certified by the
2International Certification Board and Accredited to comply
3with ISO/IEC 17024 (the conformity assessment regarding
4general requirements for bodies operating certification of
5persons) by: (1) the American National Standards Institute
6(ANSI) in HVAC fire life safety; or (2) another nationally
7recognized certifying body accredited to ISO/IEC 17024 in HVAC
8fire life safety.
9    (b) Fire damper and smoke damper inspections and testing
10shall comply with each of the following:
11        (1) Inspections shall be conducted by inspectors
12    certified by the International Certification Board and
13    accredited by:
14            (A) the American National Standards Institute; or
15            (B) another nationally recognized certifying body
16        to ISO/IEC 17024 in HVAC fire life safety.
17        (2) Inspectors under this Section shall certify that
18    all fire and smoke dampers inspected meet the standards
19    established in the applicable code or codes adopted by any
20    authority having jurisdiction.
21    (c) The provisions of this Act do not apply to facilities
22licensed by the federal Nuclear Regulatory Commission under
23the provisions of 10 CFR 50 or 10 CFR 52 or to employees of
24those facilities while engaged in the performance of their
25official duties.
