 1        AN ACT in relation to health.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5. The Department of  Public  Health  Powers  and
 5    Duties  Law  of  the Civil Administration Code of Illinois is
 6    amended by adding Section 2310-306 as follows:

 7        (20 ILCS 2310/2310-306 new)
 8        Sec. 2310-306. Sugar consumption study as it  relates  to
 9    the  health of schoolchildren. The Department, in conjunction
10    with the State Board of Education, subject to  appropriation,
11    shall  conduct  a  sugar  consumption  study to determine the
12    effects of sugar consumption as it  relates  to  the  overall
13    health  of  schoolchildren.   In  addition,  the  study shall
14    examine the impact of easy access to candy and soda  machines
15    in  schools  and  existing policies of school boards to enter
16    exclusive rights contracts with producers of soft  drinks  in
17    an  effort  to  supplement  budget shortfalls. The Department
18    shall consult with appropriate medical, dental  and  advocacy
19    groups including the soft drink industry when conducting this
20    study.  The  Department  shall  promulgate rules necessary to
21    implement the study and report its findings to  the  Governor
22    and General Assembly on or before January 1, 2004.

23        Section  99.  Effective  Date. This Act takes effect upon
24    becoming law.
