 1        AN ACT concerning speech-language pathology.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  School  Code  is  amended  by changing
 5    Section 14-1.09b as follows:

 6        (105 ILCS 5/14-1.09b)
 7        Sec. 14-1.09b.  Speech-language pathologist.
 8        (a)  For purposes of  supervision  of  a  speech-language
 9    pathology  assistant,  "speech-language  pathologist" means a
10    person who has received a license pursuant  to  the  Illinois
11    Speech-Language  Pathology  and  Audiology  Practice  Act  to
12    engage in the practice of speech-language pathology.
13        (b)  The  School  Service  Personnel  Certificate  with a
14    speech-language endorsement shall  be  issued  under  Section
15    21-25 of this Code to a speech-language pathologist who meets
16    all of the following requirements:
17             (1)  Holds   (A)  a  license  as  a  speech-language
18        pathologist  pursuant  to  the  Illinois  Speech-Language
19        Pathology and  Audiology  Practice  Act,  (B)  a  current
20        Certificate  of  Clinical  Competence  in speech-language
21        pathology  from  the   American   Speech-Language-Hearing
22        Association,  or (C) a regular license or certificate  in
23        speech-language pathology from another state or territory
24        or the District of Columbia.
25             (2) Holds a master's or doctoral degree with a major
26        emphasis in speech-language pathology from an institution
27        whose  course  of  study  was  approved  or  program  was
28        accredited by the Council on  Academic  Accreditation  in
29        Audiology  and  Speech-Language Pathology of the American
30        Speech-Language-Hearing Association or its predecessor.
31             (3)  Either (i) has completed  a  program  of  study

 1        before  July  1,  2002  that  includes  course  work  and
 2        supervised  clinical experience sufficient in breadth and
 3        depth to demonstrate knowledge and skills related to  the
 4        specific  problems,  methods and procedures applicable to
 5        students with disabilities in a  school  setting  serving
 6        ages  3  through  21  or  (ii)  meets  the  content  area
 7        standards for speech-language pathologists adopted by the
 8        State  Board of Education, in consultation with the State
 9        Teachers Certification Board.
10             (4)  Has   successfully   completed   the   required
11        Illinois certification tests.
12             (5)  Has  paid  the  application  fee  required  for
13        certification.
14        The provisions of this subsection (b) do not preclude the
15    issuance of  a  teaching  certificate  to  a  speech-language
16    pathologist who qualifies for such a certificate.

18        Section  10.   The Illinois Speech-Language Pathology and
19    Audiology Practice Act is amended by changing Section  7  and
20    adding Section 8.1 as follows:

22        (Section scheduled to be repealed on January 1, 2008)
23        Sec. 7. Licensure requirement.
24        (a)  Except  as  provided  in subsection (b), on or after
25    June  1,  1989,  no  person  shall  practice  speech-language
26    pathology  or  audiology  without  first  applying  for   and
27    obtaining  a  license  for  such purpose from the Department.
28    Except as provided in this Section, on or  after  January  1,
29    2002,  no  person shall perform the functions and duties of a
30    speech-language pathology assistant  without  first  applying
31    for  and  obtaining  a  license  for  that  purpose  from the
32    Department.

 1        (b)  A person  holding  a  regular  license  to  practice
 2    speech-language  pathology  or  audiology  under  the laws of
 3    another state, a territory  of  the  United  States,  or  the
 4    District   of  Columbia  who  has  made  application  to  the
 5    Department  for  a  license   to   practice   speech-language
 6    pathology or audiology may practice speech-language pathology
 7    or  audiology  without a license for 90 days from the date of
 8    application or until disposition of the  license  application
 9    by  the  Department,  whichever  is sooner, if the person (i)
10    holds a Certificate of Clinical Competence from the  American
11    Speech-Language-Hearing    Association   in   speech-language
12    pathology or audiology or, in the case of an  audiologist,  a
13    certificate from the American Board of Audiology and (ii) has
14    not  been disciplined and has no disciplinary matters pending
15    in a state, a territory, or the District of Columbia.

19        Sec. 8.1. Temporary license.  On  and  after  January  1,
20    2004,  a  person  who  has  met the requirements of items (a)
21    through (e) of Section 8 and intends to undertake  supervised
22    professional  experience as a speech-language pathologist, as
23    required by subsection (f) of Section 8 and the rules adopted
24    by the Department, must first obtain a temporary license from
25    the Department. A temporary license  may  be  issued  by  the
26    Department  only  to  an  applicant  pursuing  licensure as a
27    speech-language  pathologist  in  this  State.  A   temporary
28    license  shall  be issued to an applicant upon receipt of the
29    required fee as set forth by rule and documentation on  forms
30    prescribed  by  the  Department demonstrating that a licensed
31    speech-language  pathologist  has  agreed  to  supervise  the
32    professional experience of the applicant. A temporary license
33    shall be issued for a period of 12 months and may be  renewed

 1    only once for good cause shown.

 2        Section  99.  Effective date.  This Act takes effect upon
 3    becoming law.
