 1        AN ACT in relation to civil procedure.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Code of Civil  Procedure  is  amended  by
 5    changing Section 7-122 as follows:

 6        (735 ILCS 5/7-122) (from Ch. 110, par. 7-122)
 7        Sec. 7-122.  Reimbursement.  Where the State of Illinois,
 8    a political subdivision of the State, or a municipality, or a
 9    public  utility  that  is authorized to exercise the power of
10    eminent domain under Section 8-509 of  the  Public  Utilities
11    Act   is   required  by  a  court  to  initiate  condemnation
12    proceedings for the actual physical taking of real  property,
13    the  court  rendering  judgment  for  the  property owner and
14    awarding just compensation for such  taking  shall  determine
15    and  award  or  allow to such property owner, as part of such
16    judgment or award, such further sums, as will in the  opinion
17    of  the  court, reimburse such property owner for the owner's
18    reasonable  costs,  disbursements  and  expenses,   including
19    reasonable  attorney, appraisal and engineering fees actually
20    incurred by the property owner in such proceedings.

22        Section 99.  Effective date.  This Act  takes  effect  on
23    July 1, 2003.
