 1        AN ACT concerning eminent domain.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Code of Civil  Procedure  is  amended  by
 5    changing Section 7-122 as follows:

 6        (735 ILCS 5/7-122) (from Ch. 110, par. 7-122)
 7        Sec. 7-122.  Reimbursement.  Where the State of Illinois,
 8    a political subdivision of the State, or a municipality, or a
 9    public   utility   is   required   by  a  court  to  initiate
10    condemnation proceedings for the actual  physical  taking  of
11    real  property, the court rendering judgment for the property
12    owner and awarding just compensation for  such  taking  shall
13    determine  and award or allow to such property owner, as part
14    of such judgment or award, such further sums, as will in  the
15    opinion  of  the court, reimburse such property owner for the
16    owner's  reasonable  costs,   disbursements   and   expenses,
17    including reasonable attorney, appraisal and engineering fees
18    actually incurred by the property owner in such proceedings.
