 1        AN ACT in relation to public health.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5. The Department of  Public  Health  Powers  and
 5    Duties  Law  of  the Civil Administrative Code of Illinois is
 6    amended by adding Section 2310-610 as follows:

 7        (20 ILCS 2310/2310-610 new)
 8        Sec.  2310-610.  Disease  classification;  obesity.   The
 9    Department shall classify obesity as a disease.
10        For the purpose of this Section:
11        "Body  mass  index"  means a mathematical formula used to
12    determine a person's body weight in  relation  to  height  as
13    measured  by  dividing  a person's weight in kilograms by the
14    square of the person's height in meters.
15        "Obesity" means:
16             (1)  having a body mass index of 30 or greater; or
17             (2)  having a body mass index of 27 or  greater  and
18        having one or more of the following:
19                  (i)  Type II diabetes mellitus;
20                  (ii)  Impaired glucose tolerance;
21                  (iii)  Hypertension;
22                  (iv)  Cardiovascular disease;
23                  (v)  Gastric reflux disease;
24                  (vi)  Gall bladder disease;
25                  (vii)  Osteoarthritis of the hips or knees;
26                  (viii)  Sleep apnea;
27                  (ix)  Cerebrovascular disease (stroke);
28                  (x)  Coronary heart disease;
29                  (xi)  Dyslipidemia;
30                  (xii)  Gout;
31                  (xiii)  Cancer;

 1                  (xiv)  Infertility; or
 2                  (xv)  Respiratory difficulties

 3        Section  99.  Effective  date. This Act takes effect upon
 4    becoming law.
