SYNOPSIS AS INTRODUCED:
 
ILCON Art. V, Sec. 1
ILCON Art. V, Sec. 3
ILCON Art. V, Sec. 7
ILCON Art. V, Sec. 17
ILCON Art. V, Sec. 18

    Proposes to amend the Executive Article of the Illinois Constitution. Eliminates the Offices of the Comptroller and Treasurer. Provides instead for a single State Fiscal Officer. Provides that the State Fiscal Officer shall (i) maintain the State's central fiscal accounts and order payments into and out of the funds held by him or her, (ii) be responsible for the safekeeping and investment of monies and securities deposited with him or her, and for their disbursement upon his or her order, and (iii) have the duties and powers that may be prescribed by law. Effective upon being declared adopted, with the first State Fiscal Officer elected in 2006. No Comptroller or Treasurer shall be elected after 2002.

CONSTITUTIONAL AMENDMENT

 
3     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
4 NINETY-THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5 SENATE CONCURRING HEREIN, that there shall be submitted to the
6 electors of the State for adoption or rejection at the general
7 election next occurring at least 6 months after the adoption of
8 this resolution a proposition to amend Article V of the
9 Illinois Constitution by changing Sections 1, 3, 7, and 18 and
10 by repealing Section 17 as follows:

THE EXECUTIVE

13     (ILCON Art. V, Sec. 1)
14 SECTION 1. OFFICERS
15     The Executive Branch shall include a Governor, Lieutenant
16 Governor, Attorney General, Secretary of State, and State
17 Fiscal Officer Comptroller and Treasurer elected by the
18 electors of the State. They shall keep the public records and
19 maintain a residence at the seat of government during their
20 terms of office.

23 SECTION 3. ELIGIBILITY
24     To be eligible to hold the office of Governor, Lieutenant
25 Governor, Attorney General, Secretary of State, or State Fiscal
26 Officer Comptroller or Treasurer, a person must be a United
27 States citizen, at least 25 years old, and a resident of this
28 State for the three years preceding his or her election.

1 SECTION 7. VACANCIES IN OTHER ELECTIVE OFFICES
2     If the Attorney General, Secretary of State, or State
3 Fiscal Officer Comptroller or Treasurer fails to qualify or if
4 the his office becomes vacant, the Governor shall fill the
5 office by appointment. The appointee shall hold office until
6 the elected officer qualifies or until a successor is elected
7 and qualified as may be provided by law and shall not be
8 subject to removal by the Governor. If the Lieutenant Governor
9 fails to qualify or if the his office becomes vacant, it shall
10 remain vacant until the end of the term.

13 SECTION 17. COMPTROLLER - DUTIES (REPEALED)
14     The Comptroller, in accordance with law, shall maintain the
15 State's central fiscal accounts, and order payments into and
16 out of the funds held by the Treasurer.

19 SECTION 18. STATE FISCAL OFFICER TREASURER - DUTIES
20     The State Fiscal Officer Treasurer, in accordance with law,
21 shall (i) maintain the State's central fiscal accounts, and
22 order payments into and out of the funds held by him or her,
23 (ii) be responsible for the safekeeping and investment of
24 monies and securities deposited with him or her, and for their
25 disbursement upon his or her order, and (iii) have the duties
26 and powers that may be prescribed by law of the Comptroller.

SCHEDULE
29     This Constitutional Amendment takes effect upon being
30 declared adopted in accordance with Section 7 of the Illinois
31 Constitutional Amendment Act. A State Fiscal Officer, but not a
32 Comptroller or Treasurer, shall be elected in 2006 and
33 thereafter. This Constitutional Amendment otherwise applies

1 upon the conclusion of the terms of the Comptroller and the
2 Treasurer elected in 2002.
