 1        AN ACT concerning disability services.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section   5.   The   Mental   Health   and  Developmental
 5    Disabilities Administrative Act is amended by adding  Section
 6    18.5 as follows:

 7        (20 ILCS 1705/18.5 new)
 8        Sec.  18.5.  Community  Developmental Disability Services
 9    Medicaid Trust Fund; reimbursement.
10        (a) Any funds paid to the State by the federal government
11    under Title XIX or Title XXI of the Social Security  Act  for
12    services  delivered  by  community  developmental  disability
13    services providers, and any interest earned thereon, shall be
14    deposited   directly   into   the   Community   Developmental
15    Disability Services Medicaid Trust Fund.
16        (b)  The  Department  of  Human  Services shall reimburse
17    community developmental  disability  services  providers  for
18    Medicaid-reimbursed    developmental    disability   services
19    provided to eligible individuals.  Moneys  in  the  Community
20    Developmental  Disability  Services Medicaid Trust Fund shall
21    be used for this purpose.
22        (c) For the purposes of this Section:
23        "Medicaid-reimbursed developmental  disability  services"
24    means   services   provided   by  a  community  developmental
25    disability provider under an agreement  with  the  Department
26    that  is  eligible  for reimbursement under the federal Title
27    XIX program or Title XXI program.
28        "Provider" means a community agency that is funded by the
29    Department to provide a Medicaid-reimbursed service.

 1        Section  10.  The   Mental   Health   and   Developmental
 2    Disabilities  Administrative  Act  is  amended  by  repealing
 3    Section 18.1.
