SYNOPSIS AS INTRODUCED:

30 ILCS 805/8.28 new

    Amends the School Code. Requires school boards to prohibit the sale of of candy, soda pop, and chips at school or on school grounds. Amends the State Mandates Act to require implementation without reimbursement.

1     AN ACT concerning schools.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by adding Sections
5 10-20.39 and 34-18.30 as follows:
 
6     (105 ILCS 5/10-20.39 new)
7     Sec. 10-20.39. Candy, soda pop, and chip sales prohibited.
8 Each school board shall prohibit the sale of candy, soda pop,
9 and chips at school or on school grounds.
 
10     (105 ILCS 5/34-18.30 new)
11     Sec. 34-18.30. Candy, soda pop, and chip sales prohibited.
12 The board shall prohibit the sale of candy, soda pop, and chips
13 at school or on school grounds.
 
14     Section 90. The State Mandates Act is amended by adding
15 Section 8.28 as follows:
 
16     (30 ILCS 805/8.28 new)
17     Sec. 8.28. Exempt mandate. Notwithstanding Sections 6 and 8
18 of this Act, no reimbursement by the State is required for the
19 implementation of any mandate created by this amendatory Act of
20 the 93rd General Assembly.
