SYNOPSIS AS INTRODUCED:
 
515 ILCS 5/20-115   from Ch. 56, par. 20-115
520 ILCS 5/3.36   from Ch. 61, par. 3.36

    Amends the Fish and Aquatic Life Code and the Wildlife Code. Provides that no license issued under either Act shall require the applicant to disclose the applicant's Federal Insurance Contributions Act (FICA) number or Social Security number.

1     AN ACT concerning licenses.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Fish and Aquatic Life Code is amended by
5 changing Section 20-115 as follows:
 
6     (515 ILCS 5/20-115)  (from Ch. 56, par. 20-115)
7     Sec. 20-115. Form of licenses, stamps, and permits.
8 Licenses, salmon stamps, inland trout stamps, and permits
9 authorized to be issued under this Code shall be prepared by
10 the Department and shall be in the form prescribed by the
11 Department. In addition, at the time of issuance, the
12 information required on each license shall be completed on it
13 by the issuing agent or his or her sub-agent and each license
14 shall be signed by the licensee, or initialed by the designated
15 purchaser and then signed immediately upon receipt by the
16 licensee, and counter-signed by the issuing agent or his or her
17 sub-agent. All licenses shall be supplied by the Department,
18 subject to any rules and regulations as the Department may
19 prescribe, except that no application for a license issued
20 under this Act shall require the applicant to disclose the
21 applicant's Federal Insurance Contributions Act (FICA) number
22 or Social Security number. Any license not properly prepared,
23 obtained, and signed as required by this Code shall be void.

25     Section 10. The Wildlife Code is amended by changing
26 Section 3.36 as follows:

28     Sec. 3.36. Revocation and suspension.
29     (a) Whenever a license or permit is issued to any person
30 under this Act, and the holder thereof is found guilty of any

1 misrepresentation in obtaining such license or permit or of a
2 violation of any of the provisions of this Act, including
3 administrative rules, his license or permit may be revoked by
4 the Department, and the Department may refuse to issue any
5 permit or license to such person and may suspend the person
6 from engaging in the activity requiring the permit or license
7 for a period of time not to exceed 5 years following such
8 revocation.
9     Department revocation procedures shall be established by
10 Administrative rule.
11     (b) Whenever any person who has not been issued a license
12 or a permit under the provisions of this Code is found guilty
13 of a violation of the provisions of this Code, including
14 administrative rules, the Department may refuse to issue any
15 permit or license to that person, and suspend that person from
16 engaging in the activity requiring the permit or license for a
17 period of time not to exceed 5 years.
18     (c) Any person who knowingly or intentionally violates any
19 of the provisions of this Act, including administrative rules,
20 during such period when his license or permit is revoked or
21 denied by virtue of this Section or during the time he is
22 suspended under subsection (b), shall be guilty of a Class A
23 misdemeanor.
24     (d) Licenses and permits authorized to be issued under the
25 provisions of this Act shall be prepared by the Department and
26 be in such form as prescribed by the Department. The
27 information required on each license shall be completed thereon
28 by the issuing agent or his sub-agent at the time of issuance
29 and each license shall be signed by the licensee, or initialed
30 by the designated purchaser and then signed immediately upon
31 receipt by the licensee, and countersigned by the issuing agent
32 or his sub-agent at the time of issuance. All such licenses
33 shall be supplied by the Department, subject to such rules and
34 regulations as the Department may prescribe, except that no
35 application for a license issued under this Act shall require
36 the applicant to disclose the applicant's Federal Insurance

1 Contributions Act (FICA) number or Social Security number. Any
2 license not properly prepared, obtained and signed as required
3 by this Act shall be void.
4     (e) A person whose license or permit to engage in any
5 activity regulated by this Code has been suspended or revoked
6 may not, during the period of the suspension or revocation or
7 until obtaining such a license or permit, (i) be in the company
8 of any person engaging in the activity covered by the
9 suspension or revocation or (ii) serve as a guide, outfitter,
10 or facilitator for a person who is engaged or prepared to
11 engage in the activity covered by the suspension or revocation.
12     (f) No person may be issued or obtain a license or permit
13 or engage in any activity regulated by this Code during the
14 time that the person's privilege to engage in the same or
15 similar activities is suspended or revoked by another state, by
16 a federal agency, or by a province of Canada.
