SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2QQ new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that, if a seller, manufacturer, distributor, or other person offers a rebate on the retail purchase of a product in this State, the rebate must be given to the consumer by the seller at the time the consumer purchases the product, in the form of a reduction of the selling price. Provides that a seller, manufacturer, distributor, or other person that offers a rebate on the retail purchase of a product in this State may not impose, as a condition of receiving the rebate, a requirement that the consumer submit, by mail or any other means, any proof of purchase, receipt, form, documentation, or other information or tangible thing after purchasing the product. Provides that a violation is an unlawful practice within the meaning of the Act.

1     AN ACT concerning business transactions.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2QQ as follows:
 
6     (815 ILCS 505/2QQ new)
7     Sec. 2QQ. Rebates.
8     (a) If a seller, manufacturer, distributor, or other person
9 offers a rebate on the retail purchase of a product in this
10 State, the rebate must be given to the consumer by the seller
11 at the time the consumer purchases the product, in the form of
12 a reduction of the selling price. A seller, manufacturer,
13 distributor, or other person that offers a rebate on the retail
14 purchase of a product in this State may not impose, as a
15 condition of receiving the rebate, a requirement that the
16 consumer submit, by mail or any other means, any proof of
17 purchase, receipt, form, documentation, or other information
18 or tangible thing after purchasing the product.
19     (b) A person who violates this Section commits an unlawful
20 practice within the meaning of this Act.
