    Amends the Illinois Public Aid Code. Makes technical changes in a Section concerning definitions with respect to developmentally disabled care provider funding.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 changing Section 5C-1 as follows:
 
6     (305 ILCS 5/5C-1)  (from Ch. 23, par. 5C-1)
7     Sec. 5C-1. Definitions. As used In this Article, unless the
8 context requires otherwise:
9     "Fund" means the Developmentally Disabled Care Provider
10 Fund.
11     "Developmentally disabled care facility" means an
12 intermediate care facility for the mentally retarded within the
13 meaning of Title XIX of the Social Security Act, whether public
14 or private and whether organized for profit or not-for-profit,
15 but shall not include any facility operated by the State.
16     "Developmentally disabled care provider" means a person
17 conducting, operating, or maintaining a developmentally
18 disabled care facility. For this purpose, "person" means any
19 political subdivision of the State, municipal corporation,
20 individual, firm, partnership, corporation, company, limited
21 liability company, association, joint stock association, or
22 trust, or a receiver, executor, trustee, guardian or other
23 representative appointed by order of any court.
24     "Adjusted gross developmentally disabled care revenue"
25 shall be computed separately for each developmentally disabled
26 care facility conducted, operated, or maintained by a
27 developmentally disabled care provider, and means the
28 developmentally disabled care provider's total revenue for
29 inpatient residential services less contractual allowances and
30 discounts on patients' accounts, but does not include
31 non-patient revenue from sources such as contributions,
32 donations or bequests, investments, day training services,

1 television and telephone service, and rental of facility space.
