SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/4-21

    Amends the Illinois Public Aid Code. Provides that the Department of Human Services' and Department of Public Aid's rules concerning failure to cooperate shall apply to all instances of alleged recipient failure to cooperate, including failure to attend meetings, except that the rules need not be applied in the case of a meeting the sole purpose of which is to determine whether the recipient continues to meet eligibility requirements other than compliance with employment, training, or other activities. Effective immediately.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 changing Section 4-21 as follows:
 
6     (305 ILCS 5/4-21)
7     Sec. 4-21. Sanctions.
8     (a) The Illinois Department shall, by rule, establish a
9 system of sanctions for persons who fail to cooperate, without
10 good cause, with employment and training programs or other
11 programs under this Article or Article IXA or who fail to
12 cooperate with child support programs under this Article,
13 Article X, or Title IV of the federal Social Security Act. The
14 sanctions may discontinue all or part of the cash grant
15 provided under this Article. The sanctions may be time limited
16 or continue until the person cooperates in the program. The
17 sanctions may be progressive in that a second, third, or
18 further sanction may be progressively more severe or last
19 longer.
20     (b) The Illinois Department shall, by rule, define what
21 constitutes failure to cooperate and what constitutes good
22 cause which would excuse that failure. The rules developed
23 under this Section shall apply to all instances of alleged
24 recipient failure to cooperate, including failure to attend
25 meetings, except that the Illinois Department need not apply
26 these rules in instances of failure to attend a meeting for
27 which a notice to the recipient scheduling the meeting has
28 specified that the sole purpose of the meeting is to determine
29 whether the recipient continues to meet eligibility
30 requirements other than compliance with employment, training,
31 or other activities.

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.
