1     AN ACT concerning disaster service volunteers.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Disaster Service Volunteer Leave Act is
5 amended by changing Section 3 as follows:
 
6     (5 ILCS 335/3)  (from Ch. 127, par. 4053)
7     Sec. 3. Disaster Service Volunteer Leave. An employee of a
8 State agency who is a certified disaster service volunteer of
9 the American Red Cross or assigned to the Illinois Emergency
10 Management Agency in accordance with the Illinois Emergency
11 Management Agency Act, the Emergency Management Assistance
12 Compact Act, or other applicable administrative rules may be
13 granted leave from his work with pay for not more than 20
14 working days in any 12-month period to participate in
15 specialized disaster relief services for the American Red Cross
16 or for the Illinois Emergency Management Agency, as the case
17 may be, upon the request of the American Red Cross or the
18 Illinois Emergency Management Agency for the services of that
19 employee and upon the approval of that employee's agency,
20 without loss of seniority, pay, vacation time, compensatory
21 time, personal days, sick time or earned overtime accumulation.
22 The agency shall compensate an employee granted leave under
23 this Section at his regular rate of pay for those regular work
24 hours during which the employee is absent from his work. For
25 purposes of assessing State disaster response needs, requests
26 made pursuant to this Act for services out-of-state shall be
27 coordinated by the American Red Cross and the Illinois
28 Emergency Management Agency through the Illinois State
29 Emergency Operations Center. The Illinois Emergency Management
30 Agency may consult with the Department of Central Management
31 Services on leave issues that could impact the operations of
32 State agencies under the Governor's jurisdiction. Leave under

1 this Act shall not be unreasonably denied for services related
2 to a disaster within the United States or its territories be
3 granted only for services related to a disaster occurring
4 within the State of Illinois.

6     Section 10. The Local Government Disaster Service
7 Volunteer Act is amended by changing Section 15 as follows:

9     Sec. 15. Local government disaster service volunteer
10 leave. An employee of a local agency who is a certified
11 disaster service volunteer of the American Red Cross or
12 assigned to the Illinois Emergency Management Agency in
13 accordance with the Illinois Emergency Management Act, the
14 Emergency Management Assistance Compact Act, or other
15 applicable administrative rules may be granted leave from his
16 or her work with pay for not more than 20 working days in any
17 12-month period to participate in specialized disaster relief
18 services for the American Red Cross or for the Illinois
19 Emergency Management Agency, as the case may be, upon the
20 request of the American Red Cross or the Illinois Emergency
21 Management Agency for the services of that employee and upon
22 the approval of that employee's agency, without loss of
