 1        AN ACT concerning counterfeit drugs.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Department  of Public Health Powers and
 5    Duties Law of the Civil Administrative  Code  is  amended  by
 6    adding Section 2310-374 as follows:

 7        (20 ILCS 2310/2310-374 new)
 8        Sec. 2310-374.  Counterfeit drugs task force.
 9        (a)  The  Department shall create a task force to explore
10    the use of modern technologies and other measures  that  will
11    make   it   more  difficult  for  counterfeit  drugs  to  get
12    distributed with, or deliberately substituted for,  safe  and
13    effective  drugs.  The  task  force shall seek input from the
14    Department of  Professional  Regulation  and  other  federal,
15    state,  and  local  entities  that share the responsibilities
16    with the Food and Drug Administration for ensuring the safety
17    of the drug supply and distribution system.
18        (b)  The goals of the task force shall include,  but  not
19    be limited to, the following:
20             (1)  Develop a strategic action plan to decrease the
21        risk  of  counterfeit  drugs entering the marketplace and
22        protect consumers from  potentially  harmful  effects  of
23        using these products.
24             (2)  Strengthen   collaborative  relationships  with
25        other agencies, as well health  professionals,  industry,
26        consumer,  and  other stakeholders, to gather information
27        regarding  the  best  practices  for  dealing  with  drug
28        counterfeiting.
29             (3)  Identify  mechanisms  for   strengthening   the
30        protections against counterfeiting and the best practices
31        for those who sell and distribute prescription drugs.

 1             (4)  Educate patients, pharmacists, and others about
 2        how  to  identify  counterfeit  drugs and alert others to
 3        their existence.
 4             (5)  Assess the extent to which new technologies can
 5        help to assure the authenticity of drugs.
 6        (c)  The task force shall submit its initial findings and
 7    recommendations to the  General  Assembly  no  later  than  6
 8    months after the effective date of this amendatory Act of the
 9    93rd General Assembly and each year thereafter.

10        Section  99.  Effective  date. This Act takes effect upon
11    becoming law.
