 1        AN ACT in relation to methamphetamine.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5. The State Finance Act  is  amended  by  adding
 5    Section 5.595 as follows:

 6        (30 ILCS 105/5.595 new)
 7        Sec.  5.595.  The  Methamphetamine Manufacturing Facility
 8    Cleanup Fund.

 9        Section 10. The Illinois  Controlled  Substances  Act  is
10    amended by adding Section 411.3 as follows:

12        Sec.   411.3.  Methamphetamine   Manufacturing   Facility
13    Cleanup Fund.
14        (a)  There   is   created  in  the  State  treasury,  the
15    Methamphetamine Manufacturing Facility Cleanup Fund. A person
16    convicted of a violation  of  Section  401  of  this  Act  by
17    manufacturing    methamphetamine    or    by   possessing   a
18    methamphetamine manufacturing chemical  with  the  intent  to
19    manufacture  methamphetamine  shall be assessed an additional
20    fine by the court to pay for  the  cost  of  cleanup  of  the
21    facility in which the methamphetamine was being manufactured.
22        (b)  The  court  shall  impose  a minimum fine of $5 upon
23    each person convicted of a violation of Section 401  of  this
24    Act  by  manufacturing  methamphetamine  or  by  possessing a
25    methamphetamine manufacturing chemical or  a  methamphetamine
26    precursor with the intent to manufacture methamphetamine. The
27    proceeds   of   the   fine   shall   be  deposited  into  the
28    Methamphetamine Manufacturing Facility Cleanup Fund.
29        (c)  The Methamphetamine Manufacturing  Facility  Cleanup

 1    Fund  shall  be  administered by the Environmental Protection
 2    Agency.  The Agency shall make grants from the Fund to  units
 3    of  local  government  to  pay  for  the  cost  of cleanup of
 4    facilities   in   which   the   methamphetamine   was   being
 5    manufactured. The Agency shall  adopt  rules  specifying  the
 6    manner  in  which  units  of  local  government may apply for
 7    grants under this Section.
