 1        AN ACT concerning public utilities.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5. The Public Utilities Act is amended by adding
 5    Section 8-209 as follows:

 6        (220 ILCS 5/8-209 new)
 7        Sec.  8-209.  Deposits  in  connection  with   delinquent
 8    payments.  A  public utility may not require a residential or
 9    non-residential customer to make a deposit with  the  utility
10    on  the  basis  that the customer has paid a bill late unless
11    the payment is made more than 60 days after the bill is  sent
12    to  the  customer  or  unless  the  customer's wires, meters,
13    pipes, or other service equipment have been tampered with and
14    the customer has received the benefit of the tampering.
