 1        AN ACT  in relation to child support.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Illinois Public Aid Code  is  amended  by
 5    changing Section 10-3.3 as follows:

 6        (305 ILCS 5/10-3.3)
 7        Sec.   10-3.3.  Locating   support  obligor  and  others;
 8    penalties.
 9        (a)  The Child and Spouse Support Unit  may  request  and
10    receive  from  employers,  labor unions, telephone companies,
11    and  utility  companies   location   information   concerning
12    putative  fathers and noncustodial parents for the purpose of
13    establishing a child's paternity or establishing,  enforcing,
14    or  modifying  a  child support obligation.  In this Section,
15    "location  information"  means  information  about  (i)   the
16    physical  whereabouts  of  a  putative father or noncustodial
17    parent, (ii) the putative  father  or  noncustodial  parent's
18    employer,  or (iii) the salary, wages, and other compensation
19    paid and  the  health  insurance  coverage  provided  to  the
20    putative father or noncustodial parent by the employer of the
21    putative father or noncustodial parent or by a labor union of
22    which the putative father or noncustodial parent is a member.
23        The  employer of a putative father or noncustodial parent
24    or  the  labor  union  of  which  the  putative   father   or
25    noncustodial  parent is a member shall respond to the request
26    of the Child and Spouse Support Unit within 15 days after the
27    employer or labor union receives the request.   Any  employer
28    or  labor  union that willfully fails to fully respond within
29    the 15-day period shall be subject to a penalty of  $100  for
30    each  day  that  the response is not provided to the Illinois
31    Department after the 15-day period has expired.  The  penalty

 1    may  be  collected  in  a  civil action, which may be brought
 2    against the employer or labor union in favor of the  Illinois
 3    Department.
 4        (b)  Pursuant to an administrative subpoena as authorized
 5    under  this  Code,  the  Child  and  Spouse  Support Unit may
 6    request  and  receive  from  utility  companies,  and   cable
 7    television companies, and Internet service providers location
 8    information  concerning  individuals  who  owe  or  are  owed
 9    support  or  against  whom  or with respect to whom a support
10    obligation is sought.

12        Section 99.  Effective date.  This Act takes effect  upon
13    becoming law.
