 1        AN ACT concerning health maintenance organizations.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Health Maintenance  Organization  Act  is
 5    amended by adding Section 4-19 as follows:

 6        (215 ILCS 125/4-19 new)
 7        Sec. 4-19.  HMO responsible for payment.  An organization
 8    that  contracts  or  otherwise  agrees  with  or  through  an
 9    intermediary such as an independent practice association or a
10    physician-hospital  organization  for the provision of health
11    care professional or provider services shall  be  responsible
12    for  payment  to  the health care professionals or providers.
13    If  payments  are  made  to   an   intermediary,   then   the
14    intermediary  is  the  agent of the organization.  Failure of
15    the  intermediary  to  make  a  payment  to  a  health   care
16    professional  or  provider  does  not  affect the duty of the
17    health maintenance organization to make  payments  to  health
18    care professionals or providers.

19        Section  99.   Effective  date.   This  Act  takes effect
20    December 1, 2003.
