 1        AN ACT concerning merchant refunds.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Consumer  Fraud  and Deceptive Business
 5    Practices Act is amended by adding Section 2MM as follows:

 6        (815 ILCS 505/2MM new)
 7        Sec. 2MM.  Merchandise return; cash refund.
 8        (a)  A person who is engaged in the business  of  selling
 9    merchandise  and  who  accepts  returns  of  merchandise from
10    consumers shall make a cash refund to  the  consumer  at  the
11    time  the  person  accepts  a  return  of  merchandise if the
12    consumer paid cash at the time the merchandise was purchased.
13        (b)  A  person  who  violates  this  Section  commits  an
14    unlawful practice within the meaning of this Act.
