 1        AN ACT in relation to transportation.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Township  Code  is  amended  by  adding
 5    Section 30-117 as follows:

 6        (60 ILCS 1/30-117 new)
 7        Sec.  30-117.  Special  services;  disaster  relief.  The
 8    electors  may  authorize  the  use of general road and bridge
 9    funds  or  town  funds  for  the   purpose   of   collecting,
10    transporting,  and  disposing  of  brush and leaves generated
11    from those properties  contiguous  to  roads  as  defined  by
12    Section  2-103.  Further, the electors may allow general road
13    and bridge or town funds to also be used for the  purpose  of
14    providing  disaster  relief  and support services approved by
15    the Township Board of Trustees at a  regularly  scheduled  or
16    special meeting.

17        Section  10.  The  Illinois  Highway  Code  is amended by
18    changing Sections 6-201.6  and  6-201.7  and  adding  Section
19    6-201.21 as follows:

21        Sec.  6-201.6.  Direct  the  expenditure  of  all  moneys
22    collected  in the district for road purposes, including those
23    purposes allowed under Section 6-201.21  of  this  Code,  and
24    draw  warrants  on  the district treasurer therefor, provided
25    such warrants are countersigned by the district clerk.

28        Sec. 6-201.7.  Construct,  maintain  and  repair  and  be

 1    responsible  for  the construction, maintenance and repair of
 2    roads within the district, let contracts,  employ  labor  and
 3    purchase  material  and  machinery  therefor,  subject to the
 4    limitations provided in this Code.  No contract shall be  let
 5    for the construction or repair of any road or part thereof in
 6    excess  of  the  amount  of  $10,000, nor shall any material,
 7    machinery or other appliances to be used in road construction
 8    or  maintenance  of  roads  in  excess  of  such  amount   be
 9    purchased,  nor shall several contracts each for an amount of
10    $10,000 or less be let for the construction or repair of  any
11    road  or  part thereof when such construction or repair is in
12    reality part of one project costing more  than  $10,000,  nor
13    shall  any  material, machinery or other appliance to be used
14    therein be purchased under  several  contracts  each  for  an
15    amount  of $10,000 or less, if such purchases are essentially
16    one transaction amounting to more than $10,000,  without  the
17    written  approval of the county superintendent of highways in
18    the case of road districts other than  consolidated  township
19    road districts or without the written approval of the highway
20    board  of  auditors in the case of consolidated township road
21    districts.  Contracts,  labor,   machinery,   disposal,   and
22    incidental expenses related to special services under Section
23    6-201.21 of this Code constitute maintenance, for purposes of
24    this Section.
25        Except  for  professional  services,  when  the  cost  of
26    construction, materials, supplies, new machinery or equipment
27    exceeds   $10,000,   the   contract  for  such  construction,
28    materials, supplies, machinery or  equipment  shall  be  let,
29    after  the  above written approval is obtained, to the lowest
30    responsible bidder after advertising for bids at least  once,
31    and at least 10 days prior to the time set for the opening of
32    such  bids,  in  a newspaper published within the township or
33    road district, or, if no newspaper is  published  within  the
34    township  or  road  district then in one published within the

 1    county, or, if no newspaper is published  within  the  county
 2    then  in  a  newspaper  having general circulation within the
 3    township or road district, but, in case of an emergency, such
 4    contract may be let without advertising  for  bids  upon  the
 5    approval  of the County Superintendent of Highways expressing
 6    in writing the existence of such emergency and, in  the  case
 7    of consolidated township road districts, upon the approval of
 8    the  highway board of auditors.  For purposes of this Section
 9    "new machinery or equipment" shall be defined as  that  which
10    has  been  previously untitled or that which shows fewer than
11    200 hours on its operating clock and that is accompanied by a
12    new equipment manufacturer's warranty.

14        (605 ILCS 5/6-201.21 new)
15        Sec. 6-201.21. Special services; disaster relief. Subject
16    to  Section  30-117  of  the  Township  Code,   the   highway
17    commissioner  has authority to provide for orderly collection
18    and disposal of brush and  leaves  that  have  been  properly
19    placed  for  collection along the road district rights-of-way
20    in accordance with local guidelines  in  those  townships  or
21    counties  that regulate by ordinance open burning of brush or
22    leaves. Further, the highway commissioner  has  authority  to
23    provide necessary relief services following the occurrence of
24    an  event that has been declared a disaster by State or local
25    officials. The highway commissioner has purchasing authority,
26    subject to Section  6-201.6,  and  contractual  authority  as
27    defined in Section 6-201.7 of this Code.

28        Section  99.  Effective date.  This Act takes effect upon
29    becoming law.
