 1        AN ACT in relation to public health.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Department  of Public Health Powers and
 5    Duties Law of the Civil Administrative Code  of  Illinois  is
 6    amended by adding Section 2310-106 as follows:

 8        Sec.  2310-106.  Local  health protection grants; revised
 9    methodology. The Department, in cooperation with the Illinois
10    Association of Public Health Administrators, with  regard  to
11    the  allocation  of the annual appropriation for the ordinary
12    and contingent expenses of the Department for the purpose  of
13    local  health protection grants for the fiscal year beginning
14    July 1, 2004, shall revise the methodology promulgated by the
15    administrative rule governing the purpose and distribution of
16    local health protection grants, taking into consideration the
17    capacity  of  each  local  health  department   to   maintain
18    effective   programs  and  services,  population,  and  other
19    criteria significant to protecting public health. The revised
20    methodology shall include criteria, standards, and procedures
21    for  allocating  these  grants  on  a  regional  basis,  with
22    assurances that the capacity of each local health  department
23    in  effect  for  the  fiscal  year  beginning July 1, 2003 is
24    neither diminished  nor  impaired.  The  revised  methodology
25    shall  be  published  in  the Illinois Register as a proposed
26    rule on a timely basis so that the rule will be  adopted  and
27    effective July 1, 2004.
