 1        AN ACT in relation to fire equipment.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  State  Fire  Marshal  Act is amended by
 5    adding Section 2.5 as follows:

 6        (20 ILCS 2905/2.5 new)
 7        Sec. 2.5.  Equipment exchange  program.  The  Office  may
 8    create   an  equipment  exchange  program  under  which  fire
 9    departments, fire protection  districts,  and  township  fire
10    departments can donate equipment to each other.
11        A  fire department, fire protection district, or township
12    fire department that donates  fire  protection  equipment  to
13    another   fire   department,  fire  protection  district,  or
14    township fire department under this Section is not liable for
15    any damage or injury caused by the  donated  fire  protection
16    equipment,  except for damage or injury caused by the donor's
17    willful and wanton misconduct,  if  the  donor  discloses  in
18    writing  to  the  recipient  at  the time of the donation any
19    known damage to or deficiencies in the equipment.
20        This Section does not relieve any fire  department,  fire
21    protection   district,   or  township  fire  department  from
22    liability, unless otherwise provided by law, for  any  damage
23    or  injury  caused  by donated fire protection equipment that
24    was received through the equipment exchange program.

25        Section 99. Effective date. This Act  takes  effect  upon
26    becoming law.
