| 1 | | AN ACT concerning State government. | 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly: | 4 | | Section 5. The Illinois Identification Card Act is amended | 5 | | by changing Sections 4 and 12 as follows: | 6 | | (15 ILCS 335/4) | 7 | | (Text of Section before amendment by P.A. 103-210 ) | 8 | | Sec. 4. Identification card. | 9 | | (a) The Secretary of State shall issue a standard Illinois | 10 | | Identification Card to any natural person who is a resident of | 11 | | the State of Illinois who applies for such card, or renewal | 12 | | thereof. No identification card shall be issued to any person | 13 | | who holds a valid foreign state identification card, license, | 14 | | or permit unless the person first surrenders to the Secretary | 15 | | of State the valid foreign state identification card, license, | 16 | | or permit. The card shall be prepared and supplied by the | 17 | | Secretary of State and shall include a photograph and | 18 | | signature or mark of the applicant. However, the Secretary of | 19 | | State may provide by rule for the issuance of Illinois | 20 | | Identification Cards without photographs if the applicant has | 21 | | a bona fide religious objection to being photographed or to | 22 | | the display of his or her photograph. The Illinois | 23 | | Identification Card may be used for identification purposes in |

| 1 | | any lawful situation only by the person to whom it was issued. | 2 | | As used in this Act, "photograph" means any color photograph | 3 | | or digitally produced and captured image of an applicant for | 4 | | an identification card. As used in this Act, "signature" means | 5 | | the name of a person as written by that person and captured in | 6 | | a manner acceptable to the Secretary of State. | 7 | | (a-5) If an applicant for an identification card has a | 8 | | current driver's license or instruction permit issued by the | 9 | | Secretary of State, the Secretary may require the applicant to | 10 | | utilize the same residence address and name on the | 11 | | identification card, driver's license, and instruction permit | 12 | | records maintained by the Secretary. The Secretary may | 13 | | promulgate rules to implement this provision. | 14 | | (a-10) If the applicant is a judicial officer as defined | 15 | | in Section 1-10 of the Judicial Privacy Act or a peace officer, | 16 | | the applicant may elect to have his or her office or work | 17 | | address listed on the card instead of the applicant's | 18 | | residence or mailing address. The Secretary may promulgate | 19 | | rules to implement this provision. For the purposes of this | 20 | | subsection (a-10), "peace officer" means any person who by | 21 | | virtue of his or her office or public employment is vested by | 22 | | law with a duty to maintain public order or to make arrests for | 23 | | a violation of any penal statute of this State, whether that | 24 | | duty extends to all violations or is limited to specific | 25 | | violations. | 26 | | (a-15) The Secretary of State may provide for an expedited |

| 1 | | process for the issuance of an Illinois Identification Card. | 2 | | The Secretary shall charge an additional fee for the expedited | 3 | | issuance of an Illinois Identification Card, to be set by | 4 | | rule, not to exceed $75. All fees collected by the Secretary | 5 | | for expedited Illinois Identification Card service shall be | 6 | | deposited into the Secretary of State Special Services Fund. | 7 | | The Secretary may adopt rules regarding the eligibility, | 8 | | process, and fee for an expedited Illinois Identification | 9 | | Card. If the Secretary of State determines that the volume of | 10 | | expedited identification card requests received on a given day | 11 | | exceeds the ability of the Secretary to process those requests | 12 | | in an expedited manner, the Secretary may decline to provide | 13 | | expedited services, and the additional fee for the expedited | 14 | | service shall be refunded to the applicant. | 15 | | (a-20) The Secretary of State shall issue a standard | 16 | | Illinois Identification Card to a person committed to the | 17 | | Department of Corrections , the or Department of Juvenile | 18 | | Justice , a Federal Bureau of Prisons facility located in | 19 | | Illinois, or a county jail or county department of corrections | 20 | | as follows: upon receipt of the person's birth certificate, | 21 | | social security card, photograph, proof of residency upon | 22 | | discharge, and an identification card application transferred | 23 | | via a secure method as agreed upon by the Secretary and the | 24 | | Department of Corrections or Department of Juvenile Justice. | 25 | | Illinois residency shall be established by submission of a | 26 | | Secretary of State prescribed Identification Card verification |

| 1 | | form completed by the respective Department. | 2 | | (1) A committed person who has previously held an | 3 | | Illinois Identification Card or an Illinois driver's | 4 | | license shall submit an Identification Card verification | 5 | | form to the Secretary of State, including a photograph | 6 | | taken by the correctional facility, proof of residency | 7 | | upon discharge, and a social security number, if the | 8 | | committed person has a social security number. If the | 9 | | committed person does not have a social security number | 10 | | and is eligible for a social security number, the | 11 | | Secretary of State shall not issue a standard Illinois | 12 | | Identification Card until the committed person obtains a | 13 | | social security number. If the committed person's | 14 | | photograph and demographic information matches an existing | 15 | | Illinois Identification Card or Illinois driver's license | 16 | | and the Secretary of State verifies the applicant's social | 17 | | security number with the Social Security Administration, | 18 | | the Secretary of State shall issue the committed person a | 19 | | standard Illinois Identification Card. If the photograph | 20 | | or demographic information matches an existing Illinois | 21 | | Identification Card or Illinois driver's license in | 22 | | another person's name or identity, a standard Illinois | 23 | | Identification Card shall not be issued until the | 24 | | committed person submits a certified birth certificate and | 25 | | social security card to the Secretary of State and the | 26 | | Secretary of State verifies the identity of the committed |

If the Secretary of State cannot find a match to an | 2 | | existing Illinois Identification Card or Illinois driver's | 3 | | license, the committed person may apply for a standard | 4 | | Illinois Identification card as described in paragraph | 5 | | (2). | 6 | | (2) A committed person who has not previously held an | 7 | | Illinois Identification Card or Illinois driver's license | 8 | | or for whom a match cannot be found as described in | 9 | | paragraph (1) shall submit an Identification Card | 10 | | verification form, including a photograph taken by the | 11 | | correctional facility, a certified birth certificate, | 12 | | proof of residency upon discharge, and a social security | 13 | | number, if the committed has a social security number. If | 14 | | the committed person does not have a social security | 15 | | number and is eligible for a social security number, the | 16 | | Secretary of State shall not issue a standard Illinois | 17 | | Identification Card until the committed person obtains a | 18 | | social security number. If the Secretary of State verifies | 19 | | the applicant's social security number with the Social | 20 | | Security Administration, the Secretary of State shall | 21 | | issue the committed person a standard Illinois | 22 | | Identification Card. | 23 | | The Illinois Identification Card verification form | 24 | | described in this subsection shall be prescribed by the | 25 | | Secretary State. | 1 | | transfer the form. | 2 | | (a-25) The Secretary of State shall issue a limited-term | 3 | | Illinois Identification Card valid for 90 days to a committed | 4 | | person upon release on parole, mandatory supervised release, | 5 | | aftercare release, final discharge, or pardon from the | 6 | | Department of Corrections , the or Department of Juvenile | 7 | | Justice , a Federal Bureau of Prisons facility located in | 8 | | Illinois, or a county jail or county department of | 9 | | corrections , if the released person does not obtain a standard | 10 | | Illinois Identification Card as described in subsection (a-20) | 11 | | prior to release is unable to present a certified copy of his | 12 | | or her birth certificate and social security card or other | 13 | | documents authorized by the Secretary, but does present a | 14 | | Secretary of State prescribed Identification Card verification | 15 | | form completed by the correctional facility Department of | 16 | | Corrections or Department of Juvenile Justice , verifying the | 17 | | released person's date of birth, social security number, if | 18 | | the person has a social security number, and his or her | 19 | | Illinois residence address. A | 2 | | limited-term Illinois Identification Card may not be renewed. | 3 | | This subsection shall not apply to a released person who | 4 | | was unable to obtain a standard Illinois Identification Card | 5 | | because his or her photograph or demographic information | 6 | | matched an existing Illinois Identification Card or Illinois | 7 | | driver's license in another person's name or identity or to a | 8 | | released person who does not have a social security number and | 9 | | is eligible for a social security number. | 10 | | (a-30) The Secretary of State shall issue a standard | 11 | | Illinois Identification Card to a person upon conditional | 12 | | release or absolute discharge from the custody of the | 13 | | Department of Human Services, if the person presents a | 14 | | certified copy of his or her birth certificate, social | 15 | | security card, or other documents authorized by the Secretary, | 16 | | and a document proving his or her Illinois residence address. | 17 | | The Secretary of State shall issue a standard Illinois | 18 | | Identification Card to a person prior to his or her | 19 | | conditional release or absolute discharge if personnel from | 20 | | the Department of Human Services bring the person to a | 21 | | Secretary of State location with the required documents. | 22 | | Documents proving residence address may include any official | 23 | | document of the Department of Human Services showing the | 24 | | person's address after release and a Secretary of State | 25 | | prescribed verification form, which may be executed by | 26 | | personnel of the Department of Human Services. |

| 1 | | (a-35) The Secretary of State shall issue a limited-term | 2 | | Illinois Identification Card valid for 90 days to a person | 3 | | upon conditional release or absolute discharge from the | 4 | | custody of the Department of Human Services, if the person is | 5 | | unable to present a certified copy of his or her birth | 6 | | certificate and social security card or other documents | 7 | | authorized by the Secretary, but does present a Secretary of | 8 | | State prescribed verification form completed by the Department | 9 | | of Human Services, verifying the person's date of birth and | 10 | | social security number, and a document proving his or her | 11 | | Illinois residence address. The verification form must have | 12 | | been completed no more than 30 days prior to the date of | 13 | | application for the Illinois Identification Card. The | 14 | | Secretary of State shall issue a limited-term Illinois | 15 | | Identification Card to a person no sooner than 14 days prior to | 16 | | his or her conditional release or absolute discharge if | 17 | | personnel from the Department of Human Services bring the | 18 | | person to a Secretary of State location with the required | 19 | | documents. Documents proving residence address shall include | 20 | | any official document of the Department of Human Services | 21 | | showing the person's address after release and a Secretary of | 22 | | State prescribed verification form, which may be executed by | 23 | | personnel of the Department of Human Services. | 24 | | (b) The Secretary of State shall issue a special Illinois | 25 | | Identification Card, which shall be known as an Illinois | 26 | | Person with a Disability Identification Card, to any natural |

| 1 | | person who is a resident of the State of Illinois, who is a | 2 | | person with a disability as defined in Section 4A of this Act, | 3 | | who applies for such card, or renewal thereof. No Illinois | 4 | | Person with a Disability Identification Card shall be issued | 5 | | to any person who holds a valid foreign state identification | 6 | | card, license, or permit unless the person first surrenders to | 7 | | the Secretary of State the valid foreign state identification | 8 | | card, license, or permit. The Secretary of State shall charge | 9 | | no fee to issue such card. The card shall be prepared and | 10 | | supplied by the Secretary of State, and shall include a | 11 | | photograph and signature or mark of the applicant, a | 12 | | designation indicating that the card is an Illinois Person | 13 | | with a Disability Identification Card, and shall include a | 14 | | comprehensible designation of the type and classification of | 15 | | the applicant's disability as set out in Section 4A of this | 16 | | Act. However, the Secretary of State may provide by rule for | 17 | | the issuance of Illinois Person with a Disability | 18 | | Identification Cards without photographs if the applicant has | 19 | | a bona fide religious objection to being photographed or to | 20 | | the display of his or her photograph. If the applicant so | 21 | | requests, the card shall include a description of the | 22 | | applicant's disability and any information about the | 23 | | applicant's disability or medical history which the Secretary | 24 | | determines would be helpful to the applicant in securing | 25 | | emergency medical care. If a mark is used in lieu of a | 26 | | signature, such mark shall be affixed to the card in the |

| 1 | | presence of two witnesses who attest to the authenticity of | 2 | | the mark. The Illinois Person with a Disability Identification | 3 | | Card may be used for identification purposes in any lawful | 4 | | situation by the person to whom it was issued. | 5 | | The Illinois Person with a Disability Identification Card | 6 | | may be used as adequate documentation of disability in lieu of | 7 | | a physician's determination of disability, a determination of | 8 | | disability from a physician assistant, a determination of | 9 | | disability from an advanced practice registered nurse, or any | 10 | | other documentation of disability whenever any State law | 11 | | requires that a person with a disability provide such | 12 | | documentation of disability, however an Illinois Person with a | 13 | | Disability Identification Card shall not qualify the | 14 | | cardholder to participate in any program or to receive any | 15 | | benefit which is not available to all persons with like | 16 | | disabilities. Notwithstanding any other provisions of law, an | 17 | | Illinois Person with a Disability Identification Card, or | 18 | | evidence that the Secretary of State has issued an Illinois | 19 | | Person with a Disability Identification Card, shall not be | 20 | | used by any person other than the person named on such card to | 21 | | prove that the person named on such card is a person with a | 22 | | disability or for any other purpose unless the card is used for | 23 | | the benefit of the person named on such card, and the person | 24 | | named on such card consents to such use at the time the card is | 25 | | so used. | 26 | | An optometrist's determination of a visual disability |

| 1 | | under Section 4A of this Act is acceptable as documentation | 2 | | for the purpose of issuing an Illinois Person with a | 3 | | Disability Identification Card. | 4 | | When medical information is contained on an Illinois | 5 | | Person with a Disability Identification Card, the Office of | 6 | | the Secretary of State shall not be liable for any actions | 7 | | taken based upon that medical information. | 8 | | (c) The Secretary of State shall provide that each | 9 | | original or renewal Illinois Identification Card or Illinois | 10 | | Person with a Disability Identification Card issued to a | 11 | | person under the age of 21 shall be of a distinct nature from | 12 | | those Illinois Identification Cards or Illinois Person with a | 13 | | Disability Identification Cards issued to individuals 21 years | 14 | | of age or older. The color designated for Illinois | 15 | | Identification Cards or Illinois Person with a Disability | 16 | | Identification Cards for persons under the age of 21 shall be | 17 | | at the discretion of the Secretary of State. | 18 | | (c-1) Each original or renewal Illinois Identification | 19 | | Card or Illinois Person with a Disability Identification Card | 20 | | issued to a person under the age of 21 shall display the date | 21 | | upon which the person becomes 18 years of age and the date upon | 22 | | which the person becomes 21 years of age. | 23 | | (c-3) The General Assembly recognizes the need to identify | 24 | | military veterans living in this State for the purpose of | 25 | | ensuring that they receive all of the services and benefits to | 26 | | which they are legally entitled, including healthcare, |

| 1 | | education assistance, and job placement. To assist the State | 2 | | in identifying these veterans and delivering these vital | 3 | | services and benefits, the Secretary of State is authorized to | 4 | | issue Illinois Identification Cards and Illinois Person with a | 5 | | Disability Identification Cards with the word "veteran" | 6 | | appearing on the face of the cards. This authorization is | 7 | | predicated on the unique status of veterans. The Secretary may | 8 | | not issue any other identification card which identifies an | 9 | | occupation, status, affiliation, hobby, or other unique | 10 | | characteristics of the identification card holder which is | 11 | | unrelated to the purpose of the identification card. | 12 | | (c-5) Beginning on or before July 1, 2015, the Secretary | 13 | | of State shall designate a space on each original or renewal | 14 | | identification card where, at the request of the applicant, | 15 | | the word "veteran" shall be placed. The veteran designation | 16 | | shall be available to a person identified as a veteran under | 17 | | subsection (b) of Section 5 of this Act who was discharged or | 18 | | separated under honorable conditions. | 19 | | (d) The Secretary of State may issue a Senior Citizen | 20 | | discount card, to any natural person who is a resident of the | 21 | | State of Illinois who is 60 years of age or older and who | 22 | | applies for such a card or renewal thereof. The Secretary of | 23 | | State shall charge no fee to issue such card. The card shall be | 24 | | issued in every county and applications shall be made | 25 | | available at, but not limited to, nutrition sites, senior | 26 | | citizen centers and Area Agencies on Aging. | 1 | | upon receipt of such card and prior to its use for any purpose, | 2 | | shall have affixed thereon in the space provided therefor his | 3 | | signature or mark. | 4 | | (e) The Secretary of State, in his or her discretion, may | 5 | | designate on each Illinois Identification Card or Illinois | 6 | | Person with a Disability Identification Card a space where the | 7 | | card holder may place a sticker or decal, issued by the | 8 | | Secretary of State, of uniform size as the Secretary may | 9 | | specify, that shall indicate in appropriate language that the | 10 | | card holder has renewed his or her Illinois Identification | 11 | | Card or Illinois Person with a Disability Identification Card. | 12 | | (Source: P.A. 102-299, eff. 8-6-21; 103-345, eff. 1-1-24.) | 13 | | (Text of Section after amendment by P.A. 103-210 ) | 14 | | Sec. 4. If the applicant so | 4 | | requests, the card shall include a description of the | 5 | | applicant's disability and any information about the | 6 | | applicant's disability or medical history which the Secretary | 7 | | determines would be helpful to the applicant in securing | 8 | | emergency medical care. If a mark is used in lieu of a | 9 | | signature, such mark shall be affixed to the card in the | 10 | | presence of two witnesses who attest to the authenticity of | 11 | | the mark. | 1 | | (c-1) Each original or renewal Illinois Identification | 2 | | Card or Illinois Person with a Disability Identification Card | 3 | | issued to a person under the age of 21 shall display the date | 4 | | upon which the person becomes 18 years of age and the date upon | 5 | | which the person becomes 21 years of age. | 6 | | (c-3) The General Assembly recognizes the need to identify | 7 | | military veterans living in this State for the purpose of | 8 | | ensuring that they receive all of the services and benefits to | 9 | | which they are legally entitled, including healthcare, | 10 | | education assistance, and job placement. To assist the State | 11 | | in identifying these veterans and delivering these vital | 12 | | services and benefits, the Secretary of State is authorized to | 13 | | issue Illinois Identification Cards and Illinois Person with a | 14 | | Disability Identification Cards with the word "veteran" | 15 | | appearing on the face of the cards. This authorization is | 16 | | predicated on the unique status of veterans. The Secretary may | 17 | | not issue any other identification card which identifies an | 18 | | occupation, status, affiliation, hobby, or other unique | 19 | | characteristics of the identification card holder which is | 20 | | unrelated to the purpose of the identification card. | 21 | | (c-5) Beginning on or before July 1, 2015, the Secretary | 22 | | of State shall designate a space on each original or renewal | 23 | | identification card where, at the request of the applicant, | 24 | | the word "veteran" shall be placed. The veteran designation | 25 | | shall be available to a person identified as a veteran under | 26 | | subsection (b) of Section 5 of this Act who was discharged or |

| 1 | | separated under honorable conditions. | 2 | | (d) The Secretary of State may issue a Senior Citizen | 3 | | discount card, to any natural person who is a resident of the | 4 | | State of Illinois who is 60 years of age or older and who | 5 | | applies for such a card or renewal thereof. The Secretary of | 6 | | State shall charge no fee to issue such card. The card shall be | 7 | | issued in every county and applications shall be made | 8 | | available at, but not limited to, nutrition sites, senior | 9 | | citizen centers and Area Agencies on Aging.
