SYNOPSIS AS INTRODUCED:
 
20 ILCS 2705/2705-625 new

    Amends the Department of Transportation Law of the Civil Administration Code of Illinois. Establishes that the Department of Transportation shall make advance payments to its consultants for the preparatory work necessary for the consultant to provide initial personnel, equipment, supplies, and incidentals on its project with the Department. Provides that the amount paid shall be equal to 10% of the total value of the contract between the consultant and the Department. Provides that the advance payment to the consultant is an advance payment of the reported amount of the contract and is not a payment in addition to the amount of the contract; therefore, the amount of the advance payment shall be deducted from the future progress payments or the total contract amount. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Transportation Law of the
5Civil Administrative Code of Illinois is amended by adding
6Section 2705-625 as follows:
 
7    (20 ILCS 2705/2705-625 new)
8    Sec. 2705-625. Advance payments for consultants. The
9Department shall make advance payments to its consultants for
10the preparatory work necessary for the consultant to provide
11initial personnel, equipment, supplies, and incidentals on its
12project with the Department. The amount paid shall be made 14
13days prior to the consultant starting work. The amount paid
14shall be equal to 10% of the total value of the contract
15between the consultant and the Department. The advance payment
16to the consultant is an advance payment of the reported amount
17of the contract and is not a payment in addition to the amount
18of the contract; therefore, the amount of the advance payment
19shall be deducted from the future progress payments or the
20total contract amount.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.
