1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Cannabis Regulation and Tax Act is amended
5by changing Section 40-5 as follows:
 
6    (410 ILCS 705/40-5)
7    Sec. 40-5. Issuance of licenses.
8    (a) The Department shall issue transporting licenses
9through a process provided for in this Article no later than
10July 1, 2020.
11    (b) The Department shall make the application for
12transporting organization licenses available on January 7,
132020 and shall receive such applications no later than March
1415, 2020. The Department of Agriculture shall make available
15such applications on every January 7 thereafter or if that
16date falls on a weekend or holiday, the business day
17immediately succeeding the weekend or holiday and shall
18receive such applications no later than March 15 or the
19succeeding business day thereafter.
20    (c) Entities awarded a license under this Article shall
21not be required to pay any fee required under Section 40-10 of
22this Article, the nonrefundable renewal fee required under
23Section 40-40 of this Article, or any other license fee

1required under this Article or by rule from January 1, 2024 to
2January 1, 2027.
3    (d) From January 1, 2023 through January 1, 2027, the
4Department shall not make the application available for
5transporting organization licenses.
6    (e) Upon completion of the disparity and availability
7study published by the Illinois Cannabis Regulation Oversight
8Officer under subsection (e) of Section 5-45, the Department
9may modify or change the licensing application process to
10reduce or eliminate barriers and remedy discrimination
11identified in the study. Beginning January 1, 2027, the
12Department of Agriculture shall make the applications
13available on every January 7 thereafter or, if that date falls
14on a weekend or holiday, the business day immediately
15succeeding the weekend or holiday and shall receive the
16applications no later than March 15 or the succeeding business
17day thereafter.

19    Section 99. Effective date. This Act takes effect upon
20becoming law.
