SYNOPSIS AS INTRODUCED:
 
20 ILCS 2205/2205-40 new
20 ILCS 2205/2205-45 new

    Amends the Department of Healthcare and Family Services Law of the Civil Administrative Code of Illinois. Provides that the Department of Healthcare and Family Services shall implement and develop a program to establish a State prescription generic drug label for the purpose of increasing competition in the generic drug market and lowering generic drug prices for all purchasers. Provides that the Department shall contract with one or more generic drug manufacturers to manufacture certain generic drugs on behalf of the State and participating entities. Requires the Department to adopt rules to implement and administer the program. Establishes the State Generic Drug Label Task Force to study the cost savings of establishing a State prescription generic drug label. Contains provisions concerning membership on the Task Force; Task Force meetings; administrative support to the Task Force; reporting requirements; and other matters. Provides that the provisions creating the Task Force are repealed on January 1, 2025. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Healthcare and Family
5Services Law of the Civil Administrative Code of Illinois is
6amended by adding Sections 2205-40 and 2205-45 as follows:
 
7    (20 ILCS 2205/2205-40 new)
8    Sec. 2205-40. Generic prescription drug contracting. The
9Department of Healthcare and Family Services shall implement
10and develop a program to establish a State prescription
11generic drug label for the purpose of increasing competition
12in the generic drug market and lowering generic drug prices
13for all purchasers. The Department shall contract with one or
14more generic drug manufacturers to manufacture certain generic
15drugs on behalf of the State and participating entities. The
16Department shall adopt rules necessary to implement and
17administer the program created under this Section.
 
18    (20 ILCS 2205/2205-45 new)
19    Sec. 2205-45. State Generic Drug Label Task Force.
20    (a) There is hereby established the State Generic Drug
21Label Task Force to study the cost savings of establishing a
22State prescription generic drug label.

1    (b) The Task Force shall consist of the following members:
2        (1) one member of the House of Representatives
3    appointed by the Speaker of the House of Representatives
4    in consultation with the Minority Leader of the House of
5    Representatives;
6        (2) one member of the Senate appointed by the
7    President of the Senate in consultation with the Minority
8    Leader of the Senate;
9        (3) one member who is a representative of the
10    Department of Healthcare and Family Services appointed by
11    the Director of Healthcare and Family Services;
12        (4) one member from a managed care organization
13    appointed by the Director of Healthcare and Family
14    Services; and
15        (5) one member who is a pharmacist appointed by the
16    Director of Healthcare and Family Services.
17    (c) Members of the Task Force shall serve without
18compensation.
19    (d) The Department shall provide administrative support to
20the Task Force.
21    (e) The Task Force shall select from among its members a
22chairperson. The Task Force shall convene and hold its first
23meeting beginning in September 2023, and shall hold at least
24one meeting per month until the issuance of the report of the
25Task Force under subsection (f).
26    (f) The Task Force shall study the cost savings of

1establishing a State prescription generic drug label, and all
2relevant and related matters, and issue a report on its
3findings to the Governor and the General Assembly on or before
4December 31, 2023.
5    (g) This Section is repealed on January 1, 2025.
 
6    Section 99. Effective date. This Act takes effect upon
7becoming law.
