SYNOPSIS AS INTRODUCED:

50 ILCS 205/30 new

Amends the Local Records Act. Provides that a law enforcement agency that encrypts police scanner transmissions must provide, by license or otherwise, real-time access to those transmissions to broadcast stations, broadcasting stations, radio broadcast stations, and newspapers. Effective January 1, 2025.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Local Records Act is amended by adding Section 30 as follows:

(50 ILCS 205/30 new)

Sec. 30. Encrypted police scanner transmissions. A law enforcement agency that encrypts police scanner transmissions must provide, by license or otherwise, real time access to those transmissions to broadcast stations, broadcasting stations, and radio broadcast stations, as those terms are defined in 47 U.S.C. 153, and to newspapers, as that term is described in Section 5 of the Notice By Publication Act.

Section 99. Effective date. This Act takes effect January 1, 2025.
