SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-47 new

    Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to develop policies and procedures with the goal of increasing the capacity of behavioral health services provided by federally qualified health centers. Requires the Department to develop, no later than July 1, 2023, billing policies that provide reimbursement to federally qualified health centers for services rendered by graduate-level, sub-clinical behavioral health professionals who deliver care under the supervision of a fully licensed behavioral health clinician who is licensed as a clinical social worker, clinical professional counselor, marriage and family therapist, or clinical psychologist. Provides that to be eligible for reimbursement, a graduate-level, sub-clinical professional must meet the educational requirements set forth by the Department of Financial and Professional Regulation for licensed clinical social workers, licensed clinical professional counselors, licensed marriage and family therapists, or licensed clinical psychologists. Provides that an individual seeking to fulfill post-degree experience requirements in order to qualify for licensing as a clinical social worker, clinical professional counselor, marriage and family therapist, or clinical psychologist shall also be eligible for reimbursement so long as the individual complies with certain requirements. Requires the Department to work with a trade association representing a majority of federally qualified health centers operating in Illinois to develop the policies and procedures required under the amendatory Act. Effective immediately.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 5-47 as follows:
 
6    (305 ILCS 5/5-47 new)
7    Sec. 5-47. Increasing behavioral health service capacity
8in federally qualified health centers. The Department of
9Healthcare and Family Services shall develop policies and
10procedures with the goal of increasing the capacity of
11behavioral health services provided by federally qualified
12health centers as defined in Section 1905(l)(2)(B) of the
13federal Social Security Act. The Department shall develop, no
14later than July 1, 2023, billing policies that provide
15reimbursement to federally qualified health centers for
16services rendered by graduate-level, sub-clinical behavioral
17health professionals who deliver care under the supervision of
18a fully licensed behavioral health clinician who is licensed
19as a clinical social worker, clinical professional counselor,
20marriage and family therapist, or clinical psychologist.
21    To be eligible for reimbursement as provided for in this
22Section, a graduate-level, sub-clinical professional must meet
23the educational requirements set forth by the Department of

1Financial and Professional Regulation for licensed clinical
2social workers, licensed clinical professional counselors,
3licensed marriage and family therapists, or licensed clinical
4psychologists. An individual seeking to fulfill post-degree
5experience requirements in order to qualify for licensing as a
6clinical social worker, clinical professional counselor,
7marriage and family therapist, or clinical psychologist shall
8also be eligible for reimbursement under this Section so long
9as the individual is in compliance with all applicable laws
10and regulations regarding supervision, including, but not
11limited to, the requirement that the supervised experience be
12under the order, control, and full professional responsibility
13of the individual's supervisor or that the individual is
14designated by a title that clearly indicates training status.
15    The Department shall work with a trade association
16representing a majority of federally qualified health centers
17operating in Illinois to develop the policies and procedures
18required under this Section.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.
