SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/2-3.196 new

    Amends the School Code. Provides that the State Board of Education shall implement and administer a program to make New Arrival Student Grants available to school districts, municipalities, townships, and not-for-profit organizations to support the needs of students who are undocumented immigrants, have entered the United States in refugee status, or have applied for asylum in the United States. Provides that to receive a grant under this program, a school district, municipality, township, or not-for-profit organization shall submit an application to the State Board of Education at such time, in such manner, and containing or accompanied by such information as the State Board of Education may reasonably require. Provides that in awarding funds under this program, the State Board of Education may consider (i) the number of new arrival students enrolled in preschool, elementary school, and secondary school within a school district, (ii) the needs of new arrival students in a school district, and (iii) the ability of the school district, municipality, township, or not-for-profit organization to meet the needs of a arrival students. to meet the needs of new arrival students. Effective July 1, 2023.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
52-3.196 as follows:
 
6    (105 ILCS 5/2-3.196 new)
7    Sec. 2-3.196. New Arrival Student Grant Program.
8    (a) As used in this Section, "new arrival student" means a
9student who (i) is an undocumented immigrant, (ii) has entered
10the United States in refugee status, or (iii) has applied for
11asylum in the United States.
12    (b) Subject to specific State appropriation, the State
13Board of Education shall implement and administer a program to
14make New Arrival Student Grants available to school districts,
15municipalities, townships, and not-for-profit organizations to
16support the needs of new arrival students in a school
17district.
18    (c) To receive a grant under this program, a school
19district, municipality, township, or not-for-profit
20organization shall submit an application to the State Board of
21Education at such time, in such manner, and containing or
22accompanied by such information as the State Board of
23Education may reasonably require. A school district organized

1under Article 34 of this Code is not eligible to receive funds
2awarded under this program.
3    (d) The State Board of Education, subject to appropriation
4for this program, shall annually disseminate a request for
5applications to the program, and funds shall be distributed
6annually. In awarding funds under this program, the State
7Board of Education may consider (i) the number of new arrival
8students enrolled in preschool, elementary school, and
9secondary school within a school district, (ii) the needs of
10new arrival students in a school district, and (iii) the
11ability of the school district, municipality, township, or
12not-for-profit organization to meet the needs of new arrival
13students.
 
14    Section 99. Effective date. This Act takes effect July 1,
152023.
