1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Blue-Ribbon Commission on Transportation
5Infrastructure Funding and Policy Act is reenacted and amended
6by changing Sections 10, 15, 25, and 30 and by adding Section
727 as follows:

11    Sec. 1. Short title. This Act may be cited as the
12Blue-Ribbon Commission on Transportation Infrastructure
13Funding and Policy Act.

16    Sec. 5. Findings. The General Assembly finds the
17following:
18        (1) Illinois' transportation system is crucial to
19    every resident, employee, and business. It serves as the
20    backbone of the economy and is a critical component of
21    Illinois' economic competitiveness.

1        (2) The State must continue to pursue an equitable
2    transportation network in which marginalized communities
3    have improved access to all modes of transportation,
4    thereby enhancing access to jobs, housing, and other
5    services.
6        (3) Illinois is home to an expansive transportation
7    network, currently ranking third in the nation for the
8    number of roadway miles and bridges, totaling 127,044 and
9    26,848, respectively. The State also has 6,883 miles of
10    freight railway, 1,118 inland waterway miles, 58 transit
11    systems with over 450 million annual transit trips, and 17
12    major airports.
13        (4) The historic Rebuild Illinois capital plan adopted
14    in 2019 will end in June 2025.
15        (5) The motor fuel tax and vehicle registration fees
16    remain the most significant form of transportation funding
17    for Illinois.
18        (6) Illinois will continue to contend with
19    transportation funding shortfalls due to increasing
20    vehicle fuel efficiency and the rising popularity of
21    electric vehicles.
22        (7) New and innovative funding and policy options are
23    needed to adequately maintain Illinois' transportation
24    systems and support future growth.
25        (8) The General Assembly should study these issues to
26    determine funding mechanisms for transportation projects

1    and operations in Illinois, policy changes to support the
2    efficient governance and delivery of transportation
3    projects, and the workforce needed to support the future
4    transportation system.

7    Sec. 10. Commission created.
8    (a) The Blue-Ribbon Commission on Transportation
9Infrastructure Funding and Policy is created within the
10Department of Transportation consisting of members appointed
11as follows:
12        (1) Four members of the House of Representatives, with
13    2 to be appointed by the Speaker of the House of
14    Representatives and 2 to be appointed by the Minority
15    Leader of the House of Representatives.
16        (2) Four members of the Senate, with 2 to be appointed
17    by the President of the Senate and 2 to be appointed by the
18    Minority Leader of the Senate.
19        (3) Eight members appointed by the Governor with the
20    advice and consent of the Senate.
21        (4) The chair of the Commission to be appointed by the
22    Governor from among his 8 appointments.
23    (b) Members shall have expertise, knowledge, or experience
24in transportation infrastructure development, construction,
25workforce, or policy. Members shall also represent a diverse

1set of sectors, including the labor, engineering,
2construction, transit, active transportation, rail, air, or
3other sectors, and shall include participants of the
4Disadvantaged Business Enterprise Program. No more than 2
5appointees shall be members of the same sector.
6    (c) Members shall represent geographically diverse regions
7of the State.
8    (d) Members shall be appointed by June 30 January 31,
92023.

12    Sec. 15. Meetings. The Commission shall hold its first
13meeting by July 31 February 15, 2023. The Commission may
14conduct meetings at such places and at such times as it may
15deem necessary or convenient to enable it to exercise fully
16and effectively its powers, perform its duties, and accomplish
17its objectives and purposes.

20    Sec. 20. Duties. The Commission shall evaluate Illinois'
21existing transportation infrastructure funding and policy
22processes and develop alternative solutions. The Commission
23shall:
24        (1) Evaluate current transportation funding in

1    Illinois, taking into account the viability of existing
2    revenue sources and funding distributions.
3        (2) Consider new and innovative funding options.
4        (3) Evaluate the existing governance of Illinois'
5    transportation system, including roles and
6    responsibilities for the State and county, township, and
7    municipal governments.
8        (4) Evaluate current and future workforce needs to
9    design, construct, and manage the state's transportation
10    system within the Illinois Department of Transportation
11    and within the State as a whole.
12        (5) Evaluate current and future data needs of the
13    Illinois Department of Transportation.
14        (6) Consider and recommend steps to expedite project
15    approval and completion.
16        (7) Consider future trends that will impact the
17    transportation system, including safety needs, racial
18    equity, electric vehicles, and climate change.
19        (8) Consider ways to improve transportation investment
20    impacts on goals such as improving racial equity,
21    addressing climate change, and increasing economic growth.
22        (9) Consider improvements to the performance-based
23    programming system.
24        (10) Consider multimodal system needs, including
25    public transportation, bicycle facilities, railways,
26    waterways, and airports.

1        (11) Consider alternative solutions employed by other
2    states.

5    Sec. 25. Report. The Commission shall direct the Illinois
6Department of Transportation to enter into a contract with a
7third party to assist the Commission in producing a document
8that evaluates the topics under this Act and outline formal
9recommendations that can be acted upon by the General
10Assembly. The Commission shall report a summary of its
11activities and produce a final report of the data, findings,
12and recommendations to the General Assembly by January 1, 2024
13September 15, 2023. The final report shall include specific,
14actionable recommendations for legislation and organizational
15adjustments. The final report may include recommendations for
16pilot programs to test alternatives. The final report and
17recommendations shall also include any minority and individual
18views of task force members.

21    Sec. 27. Continuation of Act; validation.
22    (a) The General Assembly finds and declares that:
23        (1) Public Act 102-1129, which took effect on February
24    10, 2023, changed the repeal date set for the Blue-Ribbon

1    Commission on Transportation Infrastructure Funding and
2    Policy Act from February 1, 2023 to September 30, 2023.
3        (2) The Statute on Statutes sets forth general rules
4    on the repeal of statutes and the construction of multiple
5    amendments, but Section 1 of that Act also states that
6    these rules will not be observed when the result would be
7    "inconsistent with the manifest intent of the General
8    Assembly or repugnant to the context of the statute".
9        (3) This amendatory Act of the 103rd General Assembly
10    manifests the intention of the General Assembly to extend
11    the repeal of the Blue-Ribbon Commission on Transportation
12    Infrastructure Funding and Policy Act and have the
13    Blue-Ribbon Commission on Transportation Infrastructure
14    Funding and Policy Act continue in effect until February
15    1, 2024.
16        (4) The Blue-Ribbon Commission on Transportation
17    Infrastructure Funding and Policy Act was originally
18    enacted to protect, promote, and preserve the general
19    welfare. Any construction of this Act that results in the
20    repeal of this Act on February 1, 2023, would be
21    inconsistent with the manifest intent of the General
22    Assembly and repugnant to the context of the Blue-Ribbon
23    Commission on Transportation Infrastructure Funding and
24    Policy Act.
25    (b) It is hereby declared to have been the intent of the
26General Assembly that the Blue-Ribbon Commission on

1Transportation Infrastructure Funding and Policy Act not be
2subject to repeal on February 1, 2023.
3    (c) The Blue-Ribbon Commission on Transportation
4Infrastructure Funding and Policy Act shall be deemed to have
5been in continuous effect since May 27, 2022 (the effective
6date of Public Act 102-998), and it shall continue to be in
7effect until it is otherwise lawfully repealed. All previously
8enacted amendments to the Act taking effect on or after
9February 1, 2023, are hereby validated.
10    (d) All actions taken in reliance on or pursuant to the
11Blue-Ribbon Commission on Transportation Infrastructure
12Funding and Policy Act by any person or entity are hereby
13validated.
14    (e) In order to ensure the continuing effectiveness of the
15Blue-Ribbon Commission on Transportation Infrastructure
16Funding and Policy Act, it is set forth in full and reenacted
17by this amendatory Act of the 103rd General Assembly. Striking
18and underscoring are used only to show changes being made to
19the base text. This reenactment is intended as a continuation
20of the Act. It is not intended to supersede any amendment to
21the Act that is enacted by the 103rd General Assembly.
22    (f) The Blue-Ribbon Commission on Transportation
23Infrastructure Funding and Policy Act applies to all claims,
24civil actions, and proceedings pending on or filed on or
25before the effective date of this amendatory Act of the 103rd
26General Assembly.

2    Sec. 30. Repeal. This Commission is dissolved, and this
3Act is repealed, on February 1, 2024 September 30, 2023.
