SYNOPSIS AS INTRODUCED:
 
10 ILCS 5/28-8  from Ch. 46, par. 28-8

    Amends the Election Code. Provides that the question of whether a unit of local government shall continue to be a home rule unit (rather than shall cease to be a home rule unit) shall be submitted in a form as specified. Makes conforming changes.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing
5Section 28-8 as follows:
 
6    (10 ILCS 5/28-8)  (from Ch. 46, par. 28-8)
7    Sec. 28-8. If a referendum held in accordance with Section
828-7 of this Act involved the question of whether a unit of
9local government shall become a home rule unit or shall
10continue cease to be a home rule unit and if that referendum
11passed, then the clerk of that unit of local government shall,
12within 45 days after the referendum, file with the Secretary
13of State a certified statement showing the results of the
14referendum and the resulting status of the unit of local
15government as a home rule unit or a non-home rule unit. The
16Secretary of State shall maintain such certified statements in
17his office as a public record.
18    The question of whether a unit of local government shall
19become a home rule unit shall be submitted in substantially
20the following form:
21    Shall (name of the unit of local government) become a home
22rule unit?
23    Votes must be recorded as "yes" or "no".

4    Shall (name of the unit of local government) continue
5cease to be a home rule unit?
6    Votes must be recorded as "yes" or "no".
