SYNOPSIS AS INTRODUCED:

230 ILCS 15/8.2 new

Amends the Raffles and Poker Runs Act. Prohibits the State Board of Elections and the governing body of any county or municipality from issuing a license under the Act to a person that will offer a firearm as a prize at a poker run or raffle, unless that person is a certified licensee under the Firearm Dealer License Certification Act. Limits home rule powers. Defines "firearm".

A BILL FOR

AN ACT concerning gaming.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Raffles and Poker Runs Act is amended by adding Section 8.2 as follows:

(230 ILCS 15/8.2 new)

Sec. 8.2. Limitation on issuance of licenses for raffles and poker runs at which firearms are offered as prizes.

(a) Neither the State Board of Elections nor the governing body of a county or municipality shall issue a license under this Act to a person that will offer a firearm as a prize at a poker run or raffle, unless that person is a certified licensee under the Firearm Dealer License Certification Act.

(b) A home rule unit may not regulate the issuance of licenses under this Act in a manner inconsistent with this Section. This Section is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.

(c) As used in this Section, "firearm" has the meaning ascribed to it in Section 1.1 of the Firearm Owners Identification Card Act.
