SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/3-6007.5 new

    Amends the Counties Code. Provides that a sheriff's salary in a non-home rule county shall not be less than 80% of the State's Attorney salary for the county in which the sheriff is elected or appointed. Defines "salary". Provides that the State shall furnish 66 2/3% and the county 33 1/3% of the total annual salary to be paid to a sheriff. Prevents a county from decreasing the salary of a sheriff who earns more than 80% of the State's Attorney's salary on the effective date of the amendatory Act. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
53-6007.5 as follows:
 
6    (55 ILCS 5/3-6007.5 new)
7    Sec. 3-6007.5. Sheriff's salary.
8    (a) As used in this Section, "salary" is exclusive of any
9other compensation or benefits.
10    (b) The salary of the sheriff in a non-home rule county
11shall not be less than 80% of the salary set for the State's
12Attorney under Section 4-2001 for the county in which the
13sheriff is elected or appointed.
14    (c) The State shall furnish 66 2/3% of the total annual
15salary to be paid to a sheriff. Said amounts furnished by the
16State shall be payable monthly by the Department of Revenue
17out of the Personal Property Tax Replacement Fund or the
18General Revenue Fund to the county in which the sheriff is
19elected or appointed. The county shall furnish 33 1/3% of the
20total annual salary.
21    (d) If, on the effective date of this amendatory Act of the
22102nd General Assembly, the salary of a sheriff is greater
23than 80% of the State's Attorney's salary under Section 4-2001

1for the county in which the sheriff is elected or appointed,
2that sheriff's salary shall not be reduced.
 
3    Section 99. Effective date. This Act takes effect upon
4becoming law.
