SYNOPSIS AS INTRODUCED:
 
30 ILCS 535/43 new

    Amends the Architectural, Engineering, and Land Surveying Qualifications Based Selection Act. Provides that the Department of Transportation shall not, for the purpose of establishing overhead rates in any contract entered into between the Department and an engineering firm, consider any loans forgiven under the federal Paycheck Protection Program as a credit to the government in a way that would result in a reduced payment amount owed to the engineering firm under the contract. Provides for the adoption of rules.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Architectural, Engineering, and Land
5Surveying Qualifications Based Selection Act is amended by
6adding Section 43 as follows:
 
7    (30 ILCS 535/43 new)
8    Sec. 43. Department of Transportation overhead rates.
9Notwithstanding any provision of law to the contrary, the
10Department of Transportation shall not, for the purpose of
11establishing overhead rates in any contract entered into
12between the Department and an engineering firm under this Act,
13consider any loans forgiven under the federal Paycheck
14Protection Program as a credit to the government in a way that
15would result in a reduced payment amount owed to the
16engineering firm under the contract. The Department of
17Transportation may adopt any rules necessary to implement this
18Section.
