Amends the Barber, Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act of 1985. Provides that, in determining compliance with continuing education requirements, the Department of Financial and Professional Regulation shall accept online continuing education that has a verified attendance system completed by a licensee before January 1, 2022. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Barber, Cosmetology, Esthetics, Hair | 5 | | Braiding, and Nail
Technology Act of 1985 is amended by | 6 | | changing Sections 3-7, 3A-6, 3C-8, and 3E-5 as follows:

| 8 | | (Section scheduled to be repealed on January 1, 2026)
| 9 | | Sec. 3-7. Licensure; renewal; continuing education. The
| 10 | | holder of a license issued under this Article III may renew | 11 | | that license during
the month preceding the expiration date | 12 | | thereof by paying the required fee,
giving such evidence as | 13 | | the Department may prescribe of completing not less
than 14 | 14 | | hours of continuing education for a cosmetologist, and 24 | 15 | | hours of
continuing education for a cosmetology teacher or | 16 | | cosmetology clinic teacher,
within the 2 years prior to | 17 | | renewal. The training shall be in subjects
approved by the | 18 | | Department as prescribed by rule upon recommendation of the | 19 | | Board and may include online instruction. In determining | 20 | | compliance with the continuing education requirements of this | 21 | | Section, the Department shall accept online continuing | 22 | | education that has a verified attendance system completed by a | 23 | | licensee before January 1, 2022. |

| 1 | | For the initial renewal of a cosmetologist's license which | 2 | | requires continuing education, as prescribed by rule, one hour | 3 | | of the continuing education shall include domestic violence | 4 | | and sexual assault awareness education as prescribed by rule | 5 | | of the Department. For every subsequent renewal of a | 6 | | cosmetologist's license, one hour of the continuing education | 7 | | may include domestic violence and sexual assault awareness | 8 | | education as prescribed by rule of the Department. The | 9 | | one-hour domestic violence and sexual assault awareness | 10 | | continuing education course shall be provided by a continuing | 11 | | education provider approved by the Department, except that | 12 | | completion from March 12, 2016 to March 15, 2016 of a one-hour | 13 | | domestic violence and sexual assault awareness course from a | 14 | | domestic violence and sexual assault awareness organization | 15 | | shall satisfy this requirement.
| 16 | | The Department may prescribe rules regarding the | 17 | | requirements for domestic violence and sexual assault | 18 | | awareness continuing education courses and teachers. | 19 | | The Department shall establish by rule a means for the | 20 | | verification of
completion of the continuing education | 21 | | required by this Section. This
verification may be | 22 | | accomplished through audits of records maintained by
| 23 | | registrants, by requiring the filing of continuing education | 24 | | certificates with
the Department, or by other means | 25 | | established by the Department.

shall adopt rules defining the | 4 | | standards and criteria for
that waiver under the following | 5 | | circumstances:
| 6 | | (a) the licensee resides in a locality where it is | 7 | | demonstrated that the
absence of opportunities for such | 8 | | education would interfere with the
ability of the licensee | 9 | | to provide service to the public;
| 10 | | (b) that to comply with the continuing education | 11 | | requirements would
cause a substantial financial hardship | 12 | | on the licensee;
| 13 | | (c) that the licensee is serving in the United States | 14 | | Armed Forces; or
| 15 | | (d) that the licensee is incapacitated due to illness.

chemical service procedures, review of this Act, and | 10 | | review of the Workers'
Compensation Act. However, at least 10 | 11 | | of the hours of continuing education
required for a nail | 12 | | technology teacher
shall be in subjects relating to
teaching | 13 | | methodology, educational psychology, and classroom management | 14 | | or in
other subjects related to teaching. | 15 | | For the initial renewal of a nail technician's license | 16 | | which requires continuing education, as prescribed by rule, | 17 | | one hour of the continuing education shall include domestic | 18 | | violence and sexual assault awareness education as prescribed | 19 | | by rule of the Department. For every subsequent renewal of a | 20 | | nail technician's license, one hour of the continuing | 21 | | education may include domestic violence and sexual assault | 22 | | awareness education as prescribed by rule of the Department. | 23 | | The one-hour domestic violence and sexual assault awareness | 24 | | continuing education course shall be provided by a continuing | 25 | | education provider approved by the Department, except that | 26 | | completion from March 12, 2016 to March 15, 2016 of a one-hour |

To renew a license issued | 6 | | under this Article, an individual must produce proof of | 7 | | successful completion of 10 hours of continuing education for | 8 | | a hair braider license and 20 hours of continuing education | 9 | | for a hair braiding teacher license. | 10 | | For the initial renewal of a hair braider's license which | 11 | | requires continuing education, as prescribed by rule, one hour | 12 | | of the continuing education shall include domestic violence | 13 | | and sexual assault awareness education as prescribed by rule | 14 | | of the Department. For every subsequent renewal of a hair | 15 | | braider's license, one hour of the continuing education may | 16 | | include domestic violence and sexual assault awareness | 17 | | education as prescribed by rule of the Department. The | 18 | | one-hour domestic violence and sexual assault awareness | 19 | | continuing education course shall be provided by a continuing | 20 | | education provider approved by the Department, except that | 21 | | completion from March 12, 2016 to March 15, 2016 of a one-hour | 22 | | domestic violence and sexual assault awareness course from a | 23 | | domestic violence and sexual assault awareness organization | 24 | | shall satisfy this requirement.
