SYNOPSIS AS INTRODUCED:

625 ILCS 5/3-104.6 new

Amends the Illinois Vehicle Code. Authorizes the obtaining of a title to a materially altered vehicle primarily intended for use in parades. Provides that the title may be issued in the name of a veterans organization. Effective immediately.

A BILL FOR

AN ACT concerning vehicles.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Vehicle Code is amended by adding Section 3-104.6 as follows:

(625 ILCS 5/3-104.6 new)

Sec. 3-104.6. Application for title to materially altered vehicle.

(a) If the vehicle to be registered is a materially altered vehicle that has been modified by means of combining essential parts obtained from 2 or more antique vehicles, such fact shall be stated in the application with reference to each model of antique vehicle from which the essential parts were obtained.

(b) The applicant for the certificate of title must disclose the following:

(1) the name and address of the applicant;

(2) a description of the vehicle including a description of the vehicles from which the essential parts combined in the vehicle were obtained;

(3) the date of acquisition of the vehicle and the name of the person or entity from which the vehicle was obtained;

(4) if the vehicle was obtained from an entity that is no longer in existence, the date of dissolution of the entity; and

(5) a statement that the vehicle is primarily intended for use in parades.

(c) When the Secretary of State is satisfied as to the veracity and genuineness of the application, the Secretary of State shall issue, without bond, a certificate of title for the vehicle. If, at the time of application, the materially altered vehicle for which the application for title is filed is titled in the name of a not-for-profit veterans organization that has been involuntarily dissolved by the Secretary of State, the title may be issued in the name of an existing not-for-profit veterans organization that is or has been organizationally related to the dissolved not-for-profit veterans organization.

(d) A vehicle for which a title is obtained under this Section may be operated on a highway, street, or other road only incidentally to its primary intended use.

Section 99. Effective date. This Act takes effect upon becoming law.
