1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Professional Regulation Law
5of the Civil Administrative Code of Illinois is amended by
6changing Section 2105-15.5 as follows:
 
7    (20 ILCS 2105/2105-15.5)
8    Sec. 2105-15.5. Continuing education; sexual harassment
9prevention training.
10    (a) The Department shall require each licensee to complete
11sexual harassment prevention training provided by the
12licensee's employer, the Department of Human Rights, or any
13continuing education provider authorized to provide continuing
14education under an Act administered by the Department in
15accordance with Section 2-109 of the Illinois Human Rights
16Act. The training shall be completed, at a minimum, prior to a
17licensee's renewal of his or her license. As used in this
18Section, "sexual harassment" means any unwelcome sexual
19advances or requests for sexual favors or any conduct of a
20sexual nature when: (i) submission to such conduct is made
21either explicitly or implicitly a term or condition of an
22individual's employment; (ii) submission to or rejection of
23such conduct by an individual is used as the basis for

1employment decisions affecting such individual; or (iii) such
2conduct has the purpose or effect of substantially interfering
3with an individual's work performance or creating an
4intimidating, hostile, or offensive working environment. For
5the purpose of this definition, "working environment" is not
6limited to a physical location that an employee is assigned to
7perform his or her duties and does not require an employment
8relationship.
9    (b) For license renewals occurring on or after January 1,
102020 for a profession that has continuing education
11requirements, the required continuing education hours shall
12include at least one hour of sexual harassment prevention
13training.
14    (b) (c) The Department may adopt rules for the
15implementation of this Section.

17    Section 99. Effective date. This Act takes effect upon
18becoming law.
