HOUSE RESOLUTION

WHEREAS, A Petition was filed by Representative Jim Durkin with the Clerk of the House of Representatives on February 4, 2020, challenging the qualifications of Representative Eva Dina Delgado; and

WHEREAS, A Petition was filed by Representative Anne Stava-Murray with the Clerk of the House of Representatives on February 4, 2020, challenging the qualifications of Representative Eva Dina Delgado; and

WHEREAS, An Amended Petition was filed by Representative Jim Durkin with the Clerk of the House of Representatives on February 27, 2020, challenging the qualifications of Representative Eva Dina Delgado; and

WHEREAS, Representative Delgado was elected as the Illinois House Representative for the Third District on November 3, 2020; and

WHEREAS, The two petitioners either failed to prosecute or withdrew their respective petitions in December 2020; and

WHEREAS, A Petition for Attorney's Fees and Costs requesting reimbursement was filed by Miller Shakman Levine & Feldman LLP, as counsel for Representative Delgado, with the Clerk of the House of Representatives on January 5, 2021; and

WHEREAS, The One Hundred Second General Assembly commenced on January 13, 2021; and

WHEREAS, An Amended Petition for Attorney's Fees and Costs in the sum of $31,798 was filed by Miller Shakman Levine & Feldman LLP, as counsel for Representative Delgado, with the Clerk of the House of Representatives on March 4, 2021; and

WHEREAS, On May 10, 2021, the House Judiciary-Civil Committee held a subject matter hearing on the Amended Petition for Attorney's Fees and Costs pursuant to House Rule 88(g); and

WHEREAS, On May 12, 2021, House Judiciary-Civil Committee received a supplemental declaration from Miller Shakman Levine & Feldman LLP, which has been duly considered as part of the record in ascertaining what fees and expenses are proper under the terms of engagement, consistent with work performed, and for the purpose of ascertaining what fees and expenses are reasonable, just, and proper under the circumstances; therefore, be it

RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE HUNDRED SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the House does approve and adopt the recommendation of the House Judiciary-Civil Committee that reimbursement of attorney's fees and expenses for the sum of, and not to exceed, $25,246 in this matter are reasonable, just, and proper; and be it further

RESOLVED, That the House authorizes that reimbursement sum from any appropriations available for that purpose.
