SYNOPSIS AS INTRODUCED:
 
605 ILCS 140/5

    Amends the Expressway Camera Act. Provides that the Illinois State Police, the Illinois Department of Transportation, and the Illinois State Toll Highway Authority shall work together to conduct a program to increase the amount of cameras along all expressways within a 5-mile radius of Cook County, and within a distance of 5 miles of the location of a previous firearm discharge along an expressway within this State or within the distance between the exits nearest to the location of a previous firearm discharge along an expressway within this State, whichever is greater. Provides that the Illinois State Police and the Illinois Department of Transportation shall report monthly to the General Assembly until the cameras have been installed for a period of 2 years. Provides that the Illinois State Police shall also create an "adopt a camera" program to allow private funds to be used to install cameras if the cost of camera installation and maintenance will exceed $5 million. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Expressway Camera Act is amended by
5changing Section 5 as follows:
 
6    (605 ILCS 140/5)
7    (Section scheduled to be repealed on July 1, 2023)
8    Sec. 5. Camera program.
9    (a) The Illinois State Police, the Illinois Department of
10Transportation, and the Illinois State Toll Highway Authority
11shall work together to conduct a program to increase the
12amount of cameras along expressways in and within a 5-mile
13radius of Cook County and within a distance of 5 miles of the
14location of a previous firearm discharge along an expressway
15within this State or within the distance between the exits
16nearest to the location of a previous firearm discharge along
17an expressway within this State, whichever is greater.
18    (b) Images from the cameras may be used by any municipal
19police department, county sheriff's office, State Police
20officer, or other law enforcement agency with jurisdiction
21over the expressway in Cook County in the investigation of any
22offense involving the use of a firearm and to detect
23expressway hazards. Images from the cameras shall not be used

1to enforce petty offenses.
2    (c) Subject to appropriation, any funds needed to conduct
3the program for use on expressways under the jurisdiction of
4the Department of Transportation shall be taken from the Road
5Fund.
6    (d) As used in this Section, "expressway" has the meaning
7provided in Section 1-119.3 of the Illinois Vehicle Code.
8    (e) The Illinois State Police and the Illinois Department
9of Transportation shall report monthly to the General Assembly
10until the cameras have been installed for a period of 2 years.
11    (f) The Illinois State Police shall also create an "adopt
12a camera" program to allow private funds to be used to install
13cameras pursuant to this Act, under the jurisdiction of the
14Illinois State Police, if the cost of camera installation and
15maintenance will exceed $5 million.

17    Section 99. Effective date. This Act takes effect upon
18becoming law.
