SYNOPSIS AS INTRODUCED:
 
110 ILCS 205/17 new
110 ILCS 805/2-27 new
30 ILCS 805/8.46 new

    Amends the Board of Higher Education Act and the Public Community College Act. Provides that the Board of Higher Education and the Illinois Community College Board shall require each board of trustees of a public university or community college district in this State to establish a minimum salary for instructors that is not less than $1,333.33 per credit hour taught. Allows the minimum salary to be subject to an increase based upon a cost-of-living adjustment. Requires an annual report concerning compliance with minimum salary requirements. Provides that nothing in the provisions shall prevent the paying of instructors at a higher rate than the required minimum salary. Amends the State Mandates Act to require implementation without reimbursement.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Board of Higher Education Act is amended by
5adding Section 17 as follows:
 
6    (110 ILCS 205/17 new)
7    Sec. 17. Public university minimum salary.
8    (a) For the purposes of this Section, "public university
9board of trustees" means the Board of Trustees of the
10University of Illinois, the Board of Trustees of Southern
11Illinois University, the Board of Trustees of Chicago State
12University, the Board of Trustees of Eastern Illinois
13University, the Board of Trustees of Governors State
14University, the Board of Trustees of Illinois State
15University, the Board of Trustees of Northeastern Illinois
16University, the Board of Trustees of Northern Illinois
17University, the Board of Trustees of Western Illinois
18University, and any other board of trustees of a public
19university now or hereafter established or authorized by the
20General Assembly.
21    (b) The Board shall require each public university board
22of trustees in this State to establish a minimum salary for
23instructors that is not less than $1,333.33 per credit hour

1taught. The minimum salary set under this Section may, from
2time to time, be subject to an increase based upon a
3cost-of-living adjustment.
4    (c) Each public university board of trustees shall
5annually report to the Board its compliance with the minimum
6salary requirements of this Section, including a detailed
7listing of the salary of each instructor employed by the
8public university.
9    (d) Nothing in this Section shall prevent a public
10university board of trustees from paying instructors at a
11higher rate than the minimum salary established under this
12Section.
 
13    Section 10. The Public Community College Act is amended by
14adding Section 2-27 as follows:
 
15    (110 ILCS 805/2-27 new)
16    Sec. 2-27. Community college minimum salary.
17    (a) The State Board shall require each board to establish
18a minimum salary for instructors that is not less than
19$1,333.33 per credit hour taught. The minimum salary set under
20this Section may, from time to time, be subject to an increase
21based upon a cost-of-living adjustment.
22    (b) Each board shall annually report to the State Board
23its compliance with the minimum salary requirements of this
24Section, including a detailed listing of the salary of each

1instructor employed by the community college district.
2    (c) Nothing in this Section shall prevent a board from
3paying instructors at a higher rate than the minimum salary
4established under this Section.
 
5    Section 90. The State Mandates Act is amended by adding
6Section 8.46 as follows:
 
7    (30 ILCS 805/8.46 new)
8    Sec. 8.46. Exempt mandate. Notwithstanding Sections 6 and
98 of this Act, no reimbursement by the State is required for
10the implementation of any mandate created by this amendatory
11Act of the 102nd General Assembly.
