1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Public
5Higher Education Act.
 
6    Section 3. Intent. It is the intent of the General
7Assembly that the requirements set forth in this Act should
8apply equally to each public institution of higher education
9in this State and to the governing board of each public
10institution of higher education in this State, except as
11otherwise provided in this Act.
 
12    Section 5. Definitions. As used in this Act:
13    "Emergency contraception" means medication approved by the
14federal Food and Drug Administration (FDA) that can
15significantly reduce the risk of pregnancy if taken within 72
16hours after unprotected sexual intercourse.
17    "Governing board of each public institution of higher
18education" means the Board of Trustees of the University of
19Illinois, the Board of Trustees of Southern Illinois
20University, the Board of Trustees of Chicago State University,
21the Board of Trustees of Eastern Illinois University, the
22Board of Trustees of Governors State University, the Board of

1Trustees of Illinois State University, the Board of Trustees
2of Northeastern Illinois University, the Board of Trustees of
3Northern Illinois University, the Board of Trustees of Western
4Illinois University, or the board of any other public
5university or college now or hereafter established or
6authorized by the General Assembly.
7    "Public institution of higher education" means the
8University of Illinois, Southern Illinois University, Chicago
9State University, Eastern Illinois University, Governors State
10University, Illinois State University, Northeastern Illinois
11University, Northern Illinois University, Western Illinois
12University, or any other public university or college now or
13hereafter established or authorized by the General Assembly.
 
14    Section 10. Emergency contraception availability on
15campus.
16    (a) The governing board of each public institution of
17higher education, except the board of trustees of a community
18college district, shall make emergency contraception available
19for purchase through at least one vending machine located on
20each campus under its jurisdiction. The vending machine must
21be located in an area of campus where students can access the
22emergency contraception on weekends or after class hours.
23    (b) A public institution of higher education, except a
24public community college, shall ensure that the emergency
25contraception made available through each vending machine

1satisfies, at a minimum, all of the following requirements:
2        (1) The emergency contraception must be sold only in
3    the manufacturer's clearly labeled, original, unbroken,
4    tamper-proof, and expiration-dated packaging.
5        (2) The emergency contraception may not be older than
6    the manufacturer's expiration date.
7        (3) The emergency contraception must be stored in
8    accordance with manufacturer recommendations.
9        (4) The emergency contraception must be made available
10    at a reduced price, which may not exceed $40.
11    (c) A public institution of higher education, except a
12public community college, shall ensure that each vending
13machine has, at a minimum:
14        (1) an obvious and legible statement on the machine
15    that identifies the owner of the machine;
16        (2) a toll-free telephone number at which the consumer
17    may contact the owner of the machine; and
18        (3) a statement advising the consumer to check the
19    expiration date of the product before using the product.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
