SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/22-91 new

    Amends the School Code. Prohibits the State Board of Education, school districts, and elementary and secondary schools from requiring the teachers, other staff, or students of a school to wear a face mask due to the COVID-19 public health emergency disaster declared by the Governor pursuant to the Illinois Emergency Management Agency Act. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
522-91 as follows:
 
6    (105 ILCS 5/22-91 new)
7    Sec. 22-91. COVID-19 mask mandate prohibition.
8Notwithstanding any rule or other provision of law to the
9contrary, the State Board of Education, school districts, and
10elementary and secondary schools are prohibited from requiring
11the teachers, other staff, or students of a school to wear a
12face mask due to the COVID-19 public health emergency disaster
13declared by the Governor pursuant to Section 7 of the Illinois
14Emergency Management Agency Act.
 
15    Section 99. Effective date. This Act takes effect upon
16becoming law.
