SYNOPSIS AS INTRODUCED:
 
410 ILCS 705/5-17 new

    Amends the Cannabis Regulation and Tax Act. Creates the Illinois Cannabis Control Commission, consisting of 7 members and an Executive Director to be appointed by the Governor. Provides that, notwithstanding any other provision of law, all authority granted to the Department of Financial and Professional Regulation and the Department of Agriculture under specified provisions of the Act is granted and shall be transferred to the Illinois Cannabis Control Commission. Requires the Commission to administer and enforce provisions of the Act relating to the oversight and registration of cultivation centers, craft growers, infuser organizations, transporting organizations, or dispensing organizations or their principal officers, agents-in-charge, or agents.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Cannabis Regulation and Tax Act is amended
5by adding Section 5-17 as follows:
 
6    (410 ILCS 705/5-17 new)
7    Sec. 5-17. Cannabis Control Commission.
8    (a) There is hereby created the Illinois Cannabis Control
9Commission, consisting of 7 members to be appointed by the
10Governor with the advice and consent of the Senate, no more
11than 4 of whom shall be members of the same political party.
12The Executive Director of the Illinois Cannabis Control
13Commission shall be appointed by the Governor with the advice
14and consent of the Senate.
15    (b) Notwithstanding any other provision of law, all
16authority granted to the Department of Financial and
17Professional Regulation and the Department of Agriculture
18provided under Sections 5-10 and 5-15 is granted and shall be
19transferred to the Illinois Cannabis Control Commission.
20    (c) Notwithstanding any other provision of law, the
21Illinois Cannabis Control Commission shall administer and
22enforce the provisions of this Act relating to the oversight
23and registration of cultivation centers, craft growers,

1infuser organizations, transporting organizations, or their
2agents, including the issuance of identification cards and
3establishing limits on potency or serving size for cannabis or
4cannabis products. The Illinois Cannabis Control Commission
5may suspend or revoke the license of, impose other penalties
6upon, or otherwise discipline, cultivation centers, craft
7growers, infuser organizations, or transporting organizations
8or their principal officers, agents-in-charge, or agents for
9violations of this Act or any rules adopted under this Act.
10    (d) Notwithstanding any other provision of law, the
11Illinois Cannabis Control Commission shall administer and

13and registration of dispensing organizations or dispensing
14organization agents, including the issuance of identification
15cards for dispensing organization agents. The Illinois
16Cannabis Control Commission may suspend or revoke the license
17of, impose other penalties upon, or otherwise discipline
18dispensing organizations or a dispensing organization's
19principal officers, agents-in-charge, or agents for violations
20of this Act or any rules adopted under this Act.
