SYNOPSIS AS INTRODUCED:

410 ILCS 705/5-17 new

Amends the Cannabis Regulation and Tax Act. Creates the Illinois Cannabis Control Commission, consisting of 7 members and an Executive Director to be appointed by the Governor. Provides that, notwithstanding any other provision of law, all authority granted to the Department of Financial and Professional Regulation and the Department of Agriculture under specified provisions of the Act is granted and shall be transferred to the Illinois Cannabis Control Commission. Requires the Commission to administer and enforce provisions of the Act relating to the oversight and registration of cultivation centers, craft growers, infuser organizations, transporting organizations, or dispensing organizations or their principal officers, agents-in-charge, or agents.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Cannabis Regulation and Tax Act is amended by adding Section 5-17 as follows:

Sec. 5-17. Cannabis Control Commission.

(a) There is hereby created the Illinois Cannabis Control Commission, consisting of 7 members to be appointed by the Governor with the advice and consent of the Senate, no more than 4 of whom shall be members of the same political party. The Executive Director of the Illinois Cannabis Control Commission shall be appointed by the Governor with the advice and consent of the Senate.

(b) Notwithstanding any other provision of law, all authority granted to the Department of Financial and Professional Regulation and the Department of Agriculture provided under Sections 5-10 and 5-15 is granted and shall be transferred to the Illinois Cannabis Control Commission.

(c) Notwithstanding any other provision of law, the Illinois Cannabis Control Commission shall administer and enforce the provisions of this Act relating to the oversight and registration of cultivation centers, craft growers, infuser organizations, transporting organizations, or their agents, including the issuance of identification cards and establishing limits on potency or serving size for cannabis or cannabis products. The Illinois Cannabis Control Commission may suspend or revoke the license of, impose other penalties upon, or otherwise discipline, cultivation centers, craft growers, infuser organizations, or transporting organizations or their principal officers, agents-in-charge, or agents for violations of this Act or any rules adopted under this Act.

(d) Notwithstanding any other provision of law, the Illinois Cannabis Control Commission shall administer and enforce the provisions of this Act relating to the oversight and registration of dispensing organizations or dispensing organization agents, including the issuance of identification cards for dispensing organization agents. The Illinois Cannabis Control Commission may suspend or revoke the license of, impose other penalties upon, or otherwise discipline dispensing organizations or a dispensing organization's principal officers, agents-in-charge, or agents for violations of this Act or any rules adopted under this Act.
