SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Green Alert Program Act. Provides that each law enforcement agency shall implement a Green Alert Program for missing members of the Armed Forces. Provides that each law enforcement agency may adopt necessary rules to implement the Green Alert Program. Requires each law enforcement agency to adopt specified rules. Requires the Illinois State Police to adopt rules to assist investigating law enforcement agencies during their investigations as a resource for the receipt, analysis, and dissemination of information to those agencies that have a need and right to know about a missing member of the Armed Forces. Requires the Department of Transportation to adopt rules for the display on its variable message signs of appropriate information that may assist in the safe return of a missing member of the Armed Forces, consistent with applicable State and federal requirements. Provides that if an investigating law enforcement agency receives notice that an individual is a missing member of the Armed Forces, the agency shall solicit information from the family or legal guardian of the missing member of the Armed Forces to provide information regarding the physical or mental condition of the missing member of the Armed Forces. Requires the investigating law enforcement agency to notify the Illinois State Police of the missing member of the Armed Forces. Provides that the Illinois State Police shall make all the necessary notifications and assist the investigating law enforcement agency. Contains provisions regarding the cancellation of a Green Alert. Contains other provisions.

1    AN ACT concerning veterans.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Green
5Alert Program Act.
 
6    Section 5. Definitions. In this Act:
7    "ACIM Alert Program" or "ACIM" means "A Child is Missing
8Alert Program", a national rapid-response communication
9network that offers free assistance to law enforcement
10agencies to aid in the recovery, identity, or apprehension of
11missing persons through the use of immediate public
12notification and dissemination of information via telephone in
13a targeted community.
14    "Green Alert Program" or "Green Alert" means the
15procedures used to aid in the identification of a missing
16member of the Armed Forces.
17    "Investigating law enforcement agency" means the law
18enforcement agency that has primary jurisdiction in the area
19in which a complaint regarding a missing member of the Armed
20Forces is filed.
21    "Missing member of the Armed Forces" means an individual
22who meets all of the following:
23        (1) The individual's location is unknown.

1        (2) The individual's domicile is in this State at the
2    time the individual is reported missing.
3        (3) The individual is a veteran or an active duty
4    member of the United States Armed Forces, including the
5    National Guard or the reserves.
6        (4) The individual is known to have a physical or
7    mental health condition that is related to the
8    individual's service as an active duty member of the
9    United States Armed Forces, including the National Guard
10    or reserves.
11        (5) The individual's disappearance poses a credible
12    threat to the health or safety of the individual, as
13    determined by the investigating law enforcement agency.
14    "Veteran" means an individual who has served in the United
15States Armed Forces, including the National Guard or the
16reserves.
 
17    Section 10. Establishment of the Illinois Green Alert
18Program.
19    (a) Each law enforcement agency shall implement a Green
20Alert Program, consistent with the ACIM Alert Program, for
21missing members of the Armed Forces.
22    (b) Each law enforcement agency may adopt necessary rules
23to implement the Green Alert Program. The rules must include
24the following:
25        (1) Procedures for the use of the Illinois State

1    Police to provide support to the investigating law
2    enforcement agency as a resource for the receipt,
3    analysis, and dissemination of information regarding a
4    missing member of the Armed Forces and the whereabouts of
5    the missing member of the Armed Forces.
6        (2) Procedures for the investigating law enforcement
7    agency to use to verify whether a missing member of the
8    Armed Forces is missing and the circumstances under which
9    the agency must enter descriptive information of the
10    missing member of the Armed Forces into the Illinois State
11    Police and the National Crime Information Center system.
12        (3) The process for reporting the information to
13    designated media outlets for this State.
14    (c) The Illinois State Police shall adopt rules for the
15use of the Illinois State Police to assist investigating law
16enforcement agencies during their investigations as a resource
17for the receipt, analysis, and dissemination of information to
18those agencies that have a need and right to know about a
19missing member of the Armed Forces.
20    (d) The Department of Transportation shall adopt rules for
21the display on its variable message signs of appropriate
22information that may assist in the safe return of a missing
23member of the Armed Forces, consistent with applicable State
24and federal requirements.
 
25    Section 15. Activation of the Green Alert Program.

1    (a) If an investigating law enforcement agency receives
2notice that an individual is a missing member of the Armed
3Forces, the agency shall solicit information from the family
4or legal guardian of the missing member of the Armed Forces to
5provide information regarding the physical or mental condition
6of the missing member of the Armed Forces.
7    If the investigating law enforcement agency verifies that
8the individual is a missing member of the Armed Forces, the
9investigating law enforcement agency shall enter the
10descriptive information of the missing member of the armed
11forces into the Illinois State Police and the National Crime
12Information Center system.
13    The investigating law enforcement agency shall notify the
14Illinois State Police of the missing member of the armed
15forces. The Illinois State Police shall make all the necessary
16notifications and assist the investigating law enforcement
17agency.
18    (b) If an investigating law enforcement agency verifies
19that an individual is a missing member of the Armed Forces, the
20investigating law enforcement agency shall send an alert to
21designated media outlets for this State.
22    The alert must include all appropriate information that
23may assist in the safe return of the missing member of the
24Armed Forces, along with a statement instructing anyone with
25information relating to the missing member of the Armed Forces
26to contact the investigating law enforcement agency or another

1law enforcement agency.
2    If an investigating law enforcement agency verifies that
3an individual is a missing member of the Armed Forces, the
4investigating law enforcement agency shall contact the
5Department of Transportation. The Department of Transportation
6shall display on its variable message signs appropriate
7information that may assist in the safe return of the missing
8member of the Armed Forces.
 
9    Section 20. Cancellation of a Green Alert.
10    (a) The investigating law enforcement agency shall notify
11the designated media outlets when a Green Alert has been
12cancelled.
13    (b) A law enforcement agency that locates a missing member
14of the Armed Forces who is the subject of a Green Alert shall
15notify the Illinois State Police and the National Crime
16Information Center as soon as possible that the missing member
17of the Armed Forces has been located.
