SYNOPSIS AS INTRODUCED:

    Amends the Consumer Fraud and Deceptive Business Practices Act. Prohibits the advertising of nonwoven disposal products unless the product is flushable, septic safe, or sewer safe as provided by the Federal Trade Commission in Docket No. C-4556.

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2WWW as follows:
 
6    (815 ILCS 505/2WWW new)
7    Sec. 2WWW. Nonwoven disposal products.
8    (a) In this Section:
9        (1) "Flushable, septic safe, or sewer safe" means a
10    nonwoven disposable product that meets the tests for
11    flushability established by the Federal Trade Commission
12    in Docket No. C-4556 for non-misleading representations
13    regarding the flushability of nonwoven disposable
14    products.
15        (2) "Nonwoven disposable product" means a product
16    constructed from nonwoven sheets, including moist toilet
17    tissue or cloth, that is designed, marketed, or commonly
18    used for personal hygiene purposes.
19    (b) No nonwoven disposable product for sale in this State
20may be advertised as flushable, septic safe, or sewer safe
21unless it meets the definition set forth in paragraph (1) of
22subsection (a) of this Section.
23    (c) A violation of this Section constitutes an unlawful
